Five Surprising Facts About Skin Cancer | Denton Regional

Five Surprising Facts About Skin Cancer

Skin cancer is dangerous. Be sure to watch your skin for any changes.

Many people spend a lot of time outdoors, especially in the summer. Lounging by the pool or hitting the beach are both fun ways to spend your free time, but it?s important to take skin care precautions like wearing sunglasses and applying sunscreen regularly. You should also take a moment to read these surprising facts about skin cancer:

  1. Skin cancer is one of the most common types of cancer. Skin cancer accounts for nearly half of all cancers in the United States.
  2. It is estimated that there may be over 75,000 cases of Melanoma in 2012. There are several different types of skin cancer, but melanoma?a cancer that begins in the melanocytes, the cells that produce the skin coloring pigment known as melanin?is the most dangerous. Melanoma accounts for almost 9,000 of the nearly 12,000 skin cancer deaths each year.
  3. Tanning beds are just as dangerous as the sun?s UV rays. Many people head to tanning salons rather than the beach or pool because they assume indoor tanning is a safe alternative. Unfortunately, artificial sources of UV radiation are just as bad for your skin. In fact, tanning booths are blamed for an alarming increase in skin cancer rates nationwide.
  4. Any change on your skin, even a new mole or growth that has no color, can be a sign of skin cancer. If you notice any changes in your skin, show them to your doctor. New moles, even those that are colorless, are often a symptom of skin cancer.
  5. Skin cancer is almost 100% curable if found and treated early. Skin cancer patients? survival rates are best when the cancer is found and treated early. Always report any skin abnormalities to your doctor.

Resistance Training Program Information | Health & Fitness Review

A program of strength training is a form of training that it had been for many years under different names. You may have heard either weight lifting or toning, which is essentially the same techniques to make a profit.

Be in its basic sense, what do we methodically increase their workload, so that the muscles stimulated constantly, they are constantly working means. Interestingly, most people do not understand why they should undertake strength training exercise program, rather than simply divide in cardio workouts, which are intended for weight loss. This was actually answered by the East Carolina University. Here it was found that strength training workouts has improved the overall composition of the body by more than 30 percent.

The technique is made use of by many athletes. These range from participants in the Olympics for many football players and other athletes. It is imperative to the methodology, understand the program, which defines the end of highly effective and efficient when it comes to improving the metabolic rate. Exercises in a manner which carried out a counter-force produced against the muscles. This is done by bending, pressing, pressing or stretching. The muscle is gradually overwhelmed, leading to the formation of micro-tears in the process.

Combined with the right amount of rest with a high protein diet, these tears are recommended by the system, adding muscle to the top of the wound so that it is tearing in the future. Therefore it is important to constantly increase the workload, you can not in your muscle tissue to make sure. It is this process of repair can help you burn fat, while improving the muscle.

A major advantage of a resistance training plan is to allow flexibility for the camera, you can use. It may be that performed with bands, exercises, increase the weight machines and free weights.

The benefits that have come with such a training numerous. It is certainly highlighted the improved tone of muscle tissue and muscle strength. This not only improves the general appearance of a person, but also a better athletic performance. Also improves posture. Muscles need a lot of your energy to operate, which means that if you have more muscle, you use more calories every day, even if you do not, other physical activities! Finally, strength training workouts are also ideal for improving bone health. To decline after thirty years, the bone mass of people actually begins. This can lead to many diseases such as osteoporosis and arthritis lead. To prevent resistance workouts, bone degeneration.

While at home, workout routines can be completed through participation in the training of body weight, or you can invest in basic research. Sticking to a good stretching and flexibility program will help a long way to minimize the potential risk of injury.

Afghan activists step into social media war

Afghanistan's war by social media has stepped up a notch, with free-speech activists launching a campaign using Twitter and Facebook to fight wide confusion over competing NATO and Taliban claims, as well as looming government media curbs.

Foreign troops and insurgents have for years sparred on Twitter over the extent of victories against one another, while Afghan journalists are locked in a row with their government over press freedoms and new media laws.

"Social media is a free tool to use to transfer information without the influences of the government, warlords or Talibs," Abdul Mujeeb Khalvatgar, executive director of Afghan media advocacy group Nai, said as he launched the new campaign on Sunday.

"But right now there's the problem of having an audience," said Khalvatgar, pointing to the limited uptake of new media in a country racked by war and poverty. Just 2 million of Afghanistan's 30 million people have Internet access.

While Afghans have enthusiastically embraced improved access to phones and communications since the 2001 ousting of the former Taliban government by U.S.-backed Afghan troops, a majority continue to live in simple homes, often made of mud brick. Only one in three have electricity.

Social media fill the gap
The austere Taliban banned Internet use to stop people viewing what they derided as vulgar, immoral and anti-Islamic material, although they are now among many groups using social networking to communicate and promote their messages.

While Internet cafe use has sprouted in towns and cities, particularly among young people, the use of social media has mainly been confined to combating conservative cultural norms such as limited women's rights, which are more difficult for mainstream media to confront without provoking a backlash.

"Where traditional media are weak, that is where social media step in," Khalvatgar said.

Nai, he said, was launching its campaign to encourage government officials, rights groups and aid organizations to widen the use of social media and combat negative conceptions of the Internet among some Afghans.

Popular among women
Some Afghan families forbid women to have social media accounts, either due to interpretations of Islam or for fear of shaming family honor. When women do have accounts, they often refrain from posting pictures or real names.

"Facebook is popular among women. They can obtain information and express their opinions, and privacy settings make it easy for them to do so," said Zahra Furmoly, a 23-year-old female adviser at Nai.

And with the government mulling a media law to tighten its grip over the fledgling but lively Afghan press corps, Nai hoped social media could help safeguard political and social freedoms, as occurred during the wave of uprisings across the Middle East.

"If we increase the number of social media users, we increase dissemination of knowledge. By giving people voices on social networks, you give them hope," Khalvatgar said.

Smart league lets fans track a player's heartbeat

Niall Firth, technology editor

246705.jpg(Image: Adidas)

Get the feeling your team's star player isn't pulling his weight? Soon, US football fans will know for sure thanks to sensors that tell them everything they need to know about their team's performance.

Major League Soccer (MLS) has paired up with Adidas to make the US league - current stomping ground for former Premier League stars David Beckham and Thierry Henry among others - the world's first so-called smart league.

Starting in the 2013 season, players at all 19 MLS teams will be fitted with a chip that fits in a pocket on the base layer they wear underneath their team's shirt. This base layer will be packed with sensors that wirelessly track a player's heart rate, speed, acceleration and where they are playing on the field.

While the miCoach Elite system, as it is known, might help the team's coach know which midfielder is playing a little out of position or which defender needs to spend a bit more time on his fitness. What's exciting is the amount of data that fans watching a game will suddenly have access to.

All the information - more than 200 data records per second, claims Adidas - will be available for fans to view on an iPad app, letting them compare each player to his team-mates and see who is coasting through the game and who is really busting a gut to win. Meanwhile, coaches will be able to get an overview of how their whole squad is performing - and maybe also get an idea which opposition players they should be most wary of.

The first game to try out the miCoach system will be the MLS All-Star Game on July 25 in Philadelphia, when the best players from around Major League Soccer will play UEFA Champions League winners Chelsea.

Why Gay Parents May Be the Best Parents ? Male Express

Gay marriage, and especially gay parenting, has been in the cross hairs in recent days.

On Jan. 6, Republican presidential hopeful Rick Santorum told a New Hampshire audience that children are better off with a father in prison than being raised in a home with lesbian parents and no father at all. And last Monday (Jan. 9), Pope Benedict called gay marriage a threat ?to the future of humanity itself,? citing the need for children to have heterosexual homes.

But research on families headed by gays and lesbians doesn?t back up these dire assertions. In fact, in some ways, gay parents may bring talents to the table that straight parents don?t.

Gay parents ?tend to be more motivated, more committed than heterosexual parents on average, because they chose to be parents,? said Abbie Goldberg, a psychologist at Clark University in Massachusetts who researches gay and lesbian parenting. Gays and lesbians rarely become parents by accident, compared with an almost 50 percent accidental pregnancy rate among heterosexuals, Goldberg said. ?That translates to greater commitment on average and more involvement.?

And while research indicates that kids of gay parents show few differences in achievement, mental health, social functioning and other measures, these kids may have the advantage of open-mindedness, tolerance and role models for equitable relationships, according to some research. Not only that, but gays and lesbians are likely to provide homes for difficult-to-place children in the foster system, studies show. (Of course, this isn?t to say that heterosexual parents can?t bring these same qualities to the parenting table.)

Adopting the neediest

Gay adoption recently caused controversy in Illinois, where Catholic Charities adoption services decided in November to cease offering services because the state refused funding unless the groups agreed not to discriminate against gays and lesbians. Rather than comply, Catholic Charities closed up shop.

Catholic opposition aside, research suggests that gay and lesbian parents are actually a powerful resource for kids in need of adoption. According to a 2007 report by the Williams Institute and the Urban Institute, 65,000 kids were living with adoptive gay parents between 2000 and 2002, with another 14,000 in foster homes headed by gays and lesbians. (There are currently more than 100,000 kids in foster care in the U.S.)

An October 2011 report by Evan B. Donaldson Adoption Institute found that, of gay and lesbian adoptions at more than 300 agencies, 10 percent of the kids placed were older than 6 ? typically a very difficult age to adopt out. About 25 percent were older than 3. Sixty percent of gay and lesbian couples adopted across races, which is important given that minority children in the foster system tend to linger. More than half of the kids adopted by gays and lesbians had special needs.

The report didn?t compare the adoption preferences of gay couples directly with those of heterosexual couples, said author David Brodzinsky, research director at the Institute and co-editor of ?Adoption By Lesbians and Gay Men: A New Dimension of Family Diversity? (Oxford University Press, 2011). But research suggests that gays and lesbians are more likely than heterosexuals to adopt older, special-needs and minority children, he said. Part of that could be their own preferences, and part could be because of discrimination by adoption agencies that puts more difficult children with what caseworkers see as ?less desirable? parents.

No matter how you slice it, Brodzinsky told LiveScience, gays and lesbians are highly interested in adoption as a group. The 2007 report by the Urban Institute also found that more than half of gay men and 41 percent of lesbians in the U.S. would like to adopt. That adds up to an estimated 2 million gay people who are interested in adoption. It?s a huge reservoir of potential parents who could get kids out of the instability of the foster system, Brodzinsky said.

?When you think about the 114,000 children who are freed for adoption who continue to live in foster care and who are not being readily adopted, the goal is to increase the pool of available, interested and well-trained individuals to parent these children,? Brodzinsky said.

In addition, Brodzinsky said, there?s evidence to suggest that gays and lesbians are especially accepting of open adoptions, where the child retains some contact with his or her birth parents. And the statistics bear out that birth parents often have no problem with their kids being raised by same-sex couples, he added.

?Interestingly, we find that a small percentage, but enough to be noteworthy, [of birth mothers] make a conscious decision to place with gay men, so they can be the only mother in their child?s life,? Brodzinsky said.

Good parenting

Research has shown that the kids of same-sex couples ? both adopted and biological kids ? fare no worse than the kids of straight couples on mental health, social functioning, school performance and a variety of other life-success measures.

In a 2010 review of virtually every study on gay parenting, New York University sociologist Judith Stacey and University of Southern California sociologist Tim Biblarz found no differences between children raised in homes with two heterosexual parents and children raised with lesbian parents.

?There?s no doubt whatsoever from the research that children with two lesbian parents are growing up to be just as well-adjusted and successful? as children with a male and a female parent,? Stacey told LiveScience.

There is very little research on the children of gay men, so Stacey and Biblarz couldn?t draw conclusions on those families. But Stacey suspects that gay men ?will be the best parents on average,? she said.

That?s a speculation, she said, but if lesbian parents have to really plan to have a child, it?s even harder for gay men. Those who decide to do it are thus likely to be extremely committed, Stacey said. Gay men may also experience fewer parenting conflicts, she added. Most lesbians use donor sperm to have a child, so one mother is biological and the other is not, which could create conflict because one mother may feel closer to the kid.

?With gay men, you don?t have that factor,? she said. ?Neither of them gets pregnant, neither of them breast-feeds, so you don?t have that asymmetry built into the relationship.?

The bottom line, Stacey said, is that people who say children need both a father and a mother in the home are misrepresenting the research, most of which compares children of single parents to children of married couples. Two good parents are better than one good parent, Stacey said, but one good parent is better than two bad parents. And gender seems to make no difference. While you do find broad differences between how men and women parent on average, she said, there is much more diversity within the genders than between them.

?Two heterosexual parents of the same educational background, class, race and religion are more like each other in the way they parent than one is like all other women and one is like all other men,? she said. [6 Gender Myths Busted]

Nurturing tolerance

In fact, the only consistent places you find differences between how kids of gay parents and kids of straight parents turn out are in issues of tolerance and open-mindedness, according to Goldberg. In a paper published in 2007 in the American Journal of Orthopsychiatry, Goldberg conducted in-depth interviews with 46 adults with at least one gay parent. Twenty-eight of them spontaneously offered that they felt more open-minded and empathetic than people not raised in their situation.

?These individuals feel like their perspectives on family, on gender, on sexuality have largely been enhanced by growing up with gay parents,? Goldberg said.

One 33-year-old man with a lesbian mother told Goldberg, ?I feel I?m a more open, well-rounded person for having been raised in a nontraditional family, and I think those that know me would agree. My mom opened me up to the positive impact of differences in people.?

Children of gay parents also reported feeling less stymied by gender stereotypes than they would have been if raised in straight households. That?s likely because gays and lesbians tend to have more egalitarian relationships than straight couples, Goldberg said. They?re also less wedded to rigid gender stereotypes themselves.

?Men and women felt like they were free to pursue a wide range of interests,? Goldberg said. ?Nobody was telling them, ?Oh, you can?t do that, that?s a boy thing,? or ?That?s a girl thing.??

Same-sex acceptance

If same-sex marriage does disadvantage kids in any way, it has nothing to do with their parent?s gender and everything to do with society?s reaction toward the families, said Indiana University sociologist Brian Powell, the author of ?Counted Out:?Same-Sex Relations?and Americans? Definitions of Family? (Russell Sage Foundation, 2010).

?Imagine being a child living in a state with two parents in which, legally, only one parent is allowed to be their parent,? Powell told LiveScience. ?In that situation, the family is not seen as authentic or real by others. That would be the disadvantage.?

In her research, Goldberg has found that many children of gay and lesbian parents say that more acceptance of gay and lesbian families, not less, would help solve this problem.

In a study published online Jan. 11, 2012, in the Journal of Marriage and Family, Goldberg interviewed another group of 49 teenagers and young adults with gay parents and found that not one of them rejected the right of gays and lesbians to marry. Most cited legal benefits as well as social acceptance.

?I was just thinking about this with a couple of friends and just was in tears thinking about how different my childhood might have been had same-sex marriage been legalized 25 years ago,? a 23-year-old man raised by a lesbian couple told Goldberg. ?The cultural, legal status of same-sex couples impacts the family narratives of same-sex families ? how we see ourselves in relation to the larger culture, whether we see ourselves as accepted or outsiders.?

Hunting leopard caught on camera for the second time

First caught on film years ago, an Indian leopard was photographed recently. Spot comparison computer software aided researchers in recognizing the animal. Photos like this can help scientists track the life histories of wildlife.?

In this file photo, a leopard rests on a shelf after wandering into a store in the Sonepur district, of the eastern Indian state of Orissa. Another Indian leopard was caught on camera while hunting recently.

Researchers at the Wildlife Conservation Society analyzed the striking photograph of a male leopard carrying a massive Indian bison calf in its jaws and found that the same leopard was once photographed in 2004.

The new photograph shows the leopard carrying a guar, or bison, calf.?Leopards?use their strong jaws to haul huge prey into trees for safe-keeping. In this case, the dead calf likely weighed about 220 pounds (100 kilograms), while the leopard might weigh between 110 pounds (50 kg) and 150 pounds (70 kg).

Photographer Vinay S. Kumar snapped the photo at India's Bandipur Tiger Reserve. Kumar submitted the photo to the not-for-profit Conservation India, triggering a CSI-like chain of investigation as to the identity of the wild cat. Conservation India passed the photograph to the Wildlife Conservation Society's India Program, which maintains a database of camera-trap photos, including hundreds of?leopard photographs.

Using computer software that compares the spot patterns of the leopards, the researchers were able to identify the leopard as Bandipur Leopard #123 (BPL-123 for short). The leopard was first caught on film in December 2004, the agency reported.

"Photographs can help track the life histories of individual tigers ? and as can be seen in this case, leopards," Ullas Karanth, director of WCS's India Programs, said in a statement. "In this context, even photographs taken by tourists can be valuable in providing additional information. As this particular 'catch' shows, BPL-123 is thriving, and his superb condition is perhaps an indicator of the health of his habitat too."

Web Design: How Professional Web Designers Can Improve Your ...

The Internet is the new way to advertise your business and reach thousands of people a day. Unfortunately there are also other competitors that are advertising online too. A professional web design company knows how to design a web site and promote it to attract the highest number of customers.

Your Business Card and Store

The business web site acts as a business card and an online store. The appropriate web designing can project a very knowledgeable and polished web site. Just like you would hire someone to build and design a physical store and advertising campaign, so should you hire expert web designers to build and design your business web site. Without the expert look, your web site will lose clients.

Saving Time

A wise business owner will outsource web designing to save time. There is a lot to learn before effectively designing a web site including SEO, HTML, CSS, Photo Optimization, Search Engine Optimization, Java Script to name just a few. Most business owners do not have the time to learn all these different facets of web design quickly enough to build a professional looking web site.

Customization

With over 58,000,000 web sites on the Internet your site must stand out and attract customers that will use your business. Professional website designers will know how to design a site to suit your business needs by adding contact forms, picture galleries, FAQs, forums, and other necessary tools that are not found on pre-made templates. Expert web designers also know how to convey the correct business message using fonts, color and layout.

Finding a Web Designer

The best place to find a web designer in online. However choose a web designer that is suited to your potential clients. For example a company in India would be wise to search on the Internet for "web design company India" as professional web designers in India will know the Indian audience better than a web designer that works out of Scotland. Once you have a list of web design companies in India look through their web sites and make sure they are professional, easy to navigate and get their message across.

China's online population rises to 538? | Advanced E-Commerce,E ...

BEIJING (AP) ? China?s population of Internet users, already the world?s biggest, has risen to 538 million, driven by rapid growth in wireless Web surfing, an industry group said Thursday.

The latest figure represents an 11 percent increase from a year earlier, according to the report by the China Internet Network Information Center. The government sanctioned group said that raised the share of China?s population that uses the Internet to 39.9 percent.

The number of people who go online from mobile phones and other wireless devices rose to 388 million, the group said. That was up 22 percent from a year earlier.

China?s communist government encourages Internet use for business and education but tries to block access to material considered subversive or obscene. Authorities tightened controls after social networking and other websites played a key role in protests that brought down governments in Egypt and Tunisia.

The rise of Internet use and the explosive popularity of wireless access have driven the growth of a series of new Chinese industries from microblogs to online video.

This month, regulators tightened control over online video, telling providers they must prescreen all material before making it available. The government complained that some online video was vulgar, pornographic or too violent.

Rogers offers 6GB Super Plan, guarantees that Galaxy S III will stay busy

Cellular promos come and go. Rogers, however, wants to make sure that its 6GB Super Plan is one to remember: the carrier is offering the 6GB of monthly data that has become its summer tradition, only this time as part of a bigger plan that tucks in 200 minutes, unlimited messaging and the usual evening and favorites perks for voice calls. At $60, the combo isn't just a better deal than usual, it's impossible to build otherwise -- the closest that exists is a $73 monthly plan that tops out at 3GB. The promo's August 8th cutoff date doesn't afford much breathing room for would-be adopters, but it should let new Galaxy S III buyers milk that LTE for all it's worth.

University of Toronto to offer free online courses

The University of Toronto will be offering some of its courses free online this?

Here at Maclean's, we appreciate the written word. And we appreciate you, the reader. We are always looking for ways to create a better user experience for you and wanted to try out a new functionality that provides you with a reading experience in which the words and fonts take centre stage. We believe you'll appreciate the clean, white layout as you read our feature articles. But we don't want to force it on you and it's completely optional. Click "View in Clean Reading Mode" on any article if you want to try it out. Once there, you can click "Go back to regular view" at the top or bottom of the article to return to the regular layout.

The University of Toronto will be offering some of its courses free online this year. This may signal diminishing resistance of Canadian universities to the growing movement in the US?for free online university education.

U of T will offer five free classes in the coming year in partnership with US company Coursera, a company based in California. It will be the only Canadian university working with the company, which has attracted 700,000 students.

The Star quotes Cheryl Misak, U of T?s ?provost, as saying ?It?s a great service to the world and it?s great for the University of Toronto.?This is the most open of all courses ? anyone sitting in any country around the world with access to a computer can take the course.? The courses are not for official credit.

The Massachusetts Institute of Technology has pioneered the free delivery of university courses through a service called ?MITx. Canadian universities have not yet shown the same level of enthusiasm.

Nokia grows Destination Maps coverage to 4,605 venues in 38 countries, coming to Nokia Maps soon

After covering more than 23 million miles of the world's roadways, Nokia has focused on expanding its interior mapping footprint. Since its launch during CTIA 2011, the company's Destination Maps service has grown to cover a total of 4,605 different venues in 38 countries, including airports, department stores, shopping malls and transit hubs. As you can see in the infographic above, the majority of those locations are in North America, with a total of 2,595 mapped on the continent, followed by 1,778 in EMEA, 225 in the Asia Pacific region and just seven in Latin America -- that's 235 million square feet in all. Nokia also promises much more to come in the future, with hints identifying amusement parks and stadiums as possible beneficiaries. The company also reiterated its recent partnership with Bing, adding that Nokia Maps will have access to Destination Maps in the not-so-distant future as well. You'll find a few more details at the source link below, and while we don't have precise predictions to share, you can rest easy knowing that Nokia's indoor effort is far from complete.

Building a First Aid Kit for Camping | Travel & Leisure

Before you head out, make sure you are prepared with the basics in case of any minor injuries that might occur while out in the wilderness. When hiking, each backpack should carry one. You never know if you will get separated from your party. All the items are very inexpensive and serve an important purpose in making a victim more comfortable and is not a replacement for medical attention.

  • Assorted bandages and gauze rolls (include at least one small elastic bandage)
  • Antiseptic creams and ointments
  • Pain Medication
  • Tweezers, scissors, and knife
  • Sunburn care (Sunscreen, aloe vera, burn cream)
  • Anti-diarrhea medication
  • Saline solution
  • Benedryl

Because the threat of scrapes and cuts is so high while you camp, several different sizes of bandages are recommended. Make sure there are some that fit small children if they will be with you. Gauze pads and rolls are nice for the types of wounds that bandages can?t cover up. A roll of first aid tape might come in handy too and the elastic bandage for sprains. Generally small ones for the arms and hands, large ones for the legs and feet. These also work great to hold an ice pack on the head or mid-section of the body.

Neosporin, hydrogen peroxide, and Calamine Lotion are nice to have for preventing infections. Always use the Neosporin under a bandaid. Washing cuts and scrapes with the peroxide helps to kill germs that cause infection and washing with sterile saline before bandaging promotes healing. Calamine is applied to bites or plant allergies like poison ivy to relieve itching and prevent fingernails from tearing the skin up.

Tylenol and Advil for adults and kids are great pain management medications for minor accidents. Follow manufacturer guidelines when taking these medications. Both can be used for pain and Advil, or Ibuprofen, can be taken to reduce swelling.

Tweezers are great for removing splinters and slivers, which happens a lot! Use the scissors or a knife to cut the tape and gauze.

Keeping your sunscreen in your first aid kit is smart, then you will always know where it is at. Bring lotion and aloe for sunburn care but also burn cream in the event of campfire injuries.

Many times, the food eaten while camping will not agree with your stomach so Pepto Bismol and Immodium are nice to have with you when those very uncomfortable moments strike in your camp. Throwing in some Tums isn?t a bad idea either!

When buying saline solution, be certain it does not contain extra chemicals used to clean contact lenses. Only get straight saline for rinsing wounds or flushing debris out of eyes.

One item I never camp without is Benedryl. Sometimes one just never knows what the heck they are really allergic to until they have nothing with them to help the reaction. A Murphy?s Law deal perhaps? Take it with you whether you are allergic to anything or not. You may find someone in need of your assistance and save their life with it. It is always better to be prepared.

Find a container to house all of these things together so when anything happens, everyone in your party knows where to go to take care of their ailments. Make it a rule that anything taken out is returned (with the exception of bandages, ha!) so there is never a moment of panic hunting for a piece of the puzzle. When leaving for a daytrip, be sure all members with you have a small kit with them just in case. It is better to be safe than sorry. Happy Camping! ?For more information about RV travel and RV vacation, there?s great information online.

SafetyAtWorkBlog: John Darley's delay on Work Health and Safety ...

South Australia still has not passed the Work Health and Safety legislation that would bring it into line with most of the other States of Australia. ?A major obstacle to the Bill's progress in the South Australian Parliament is the?"dithering"?of Independent MP?John?Darley. Darley refers to the views of the?Housing Industry?(HIA) and Master Builders' Associations (MBA) on "control", two groups he acknowledges are "the most vocal opponents" of the Bill, and states
"Any person who does not have direct control of a risk should not have responsibility for eliminating or minimising the risk".

Consider this position in relation to workplace psychosocial hazards. ?A bully would be breaching OHS laws by bullying another worker but those executives who establish the culture of a workplace that condones the bully's actions would not be facing any penalty. ?This scenario seems to contradict a dominant safety principle that compliance and respect stems from the active example shown by an organisation's leader. ?How will the legislative obligation for a "positive duty of care" in workplaces apply with in-direct control?

Darley says that the government is prepared to

"insert an additional clause that further qualifies a PCBU's responsibility by providing that, if a person does not have direct control of a particular risk, the extent to which they must eliminate or minimise the risk depends on the extent to which they have the capacity to influence the matter."

This provides considerable wriggle room in corporate compliance by weakening the concept of the Person Conducting Business or Undertaking but, apparently the MBA and HIA remain?unsatisfied.

On "union right of entry", a contentious element in the WHS laws in those States that have not already resolved the issue, Darley considers the HIA/MBA objections in detail but ?does not mention a union position to balance the legislative debate. ?Instead, curiously, he ties union right of entry with the performance and conduct of SafeWork SA. ?Darley appears to be?no friend of SafeWork SA?and yet is a member of a committee investigating SafeWork SA. ?On grounds of fairness, it would have seemed better to avoid any comment on any SafeWork SA issues until after the findings of the?Parliamentary Committee on Occupational Safety, Rehabilitation and Compensation. ?The apparent sympathies Darley has for the dogged positions of the HIA and MBA indicate a challenge for the chair of committee, Australian Labor Party MP,?Steph Key.

Darley indicates that

"a significant change in the culture and attitude of SafeWork SA"

is required for any new OHS legislation. ?He says that

"workers do not trust SafeWork SA."

Darley ?sees

"no point in introducing new laws if they are not accompanied by adequate?resourcing?in the areas that count, not just in areas that appear in government television advertisements or awards for good performance, but in expenditure for more inspectors on the ground at the coalface, ensuring accidents do not occur in the first place."

Darley misses a core element of not only the new WHS laws but the existing OHS laws in South Australia. The primary duty of care and safety responsibility in any workplace is held by the employer and?not?the OHS?regulator.

His comments imply that South Australia is unlikely to have any new Work Health and Safety laws until the Key Committee inquiry is completed and SafeWork SA complies with any Committee recommendations for change. ?No date is set for the inquiry's conclusion.

The HIA and MBA may feel?comfortable?by not having union OHS reps entering their worksites but, extrapolating from Darley's position, these worksites would likely have greatly increased scrutiny from SafeWork SA inspectors. ?What would be easier to resolve, a union stopping unsafe work on a construction site or a government agency stopping the work?

And is Darley really suggesting that, as the Work Health and Safety harmonisation process is intended to achieve, increased worksite intervention from a government safety regulator will reduce the "red tape" cost of compliance?

Darley says in Hansard that he looked into the matter of red tape during a visit to New South Wales. ?(It has been suggested that he is currently undertaking a similar trip to Queensland.) ?Given his predilection for information from HIA and MBA, it is not surprising that some of the "stakeholder groups" he met were from the building industry. ?In fact he states

"the impression I got from builders was one of too much red tape."

The constant oversight of safety on worksites by SafeWork SA, Darley expects, will surely help that. ?Not.

Darley also fundamentally misunderstands the reason for the new Work Health and Safety laws. ?He states

"The intention of this legislation is not to bog businesses down in paperwork: it is to improve workers' safety."
"... cut red tape, boost business efficiency and provide greater certainty and protections for all workplace parties." (page ii)
"The fundamental objective of the reform covered by this Agreement is to ?produce the optimal model for a national approach to OHS regulation and ?operation which will:
(a) enable the development of uniform, equitable and effective safety ?standards and protections for all Australian workers;
(b) address the compliance and regulatory burdens for employers with ?operations in more than one jurisdiction;
(c) create efficiencies for governments in the provision of OHS regulatory ?and support services; and
(d) achieve significant and continual reductions in the incidence of death, injury and disease in the workplace."

A decrease in workplace injuries and harm does not come from laws but from ?the application of those laws. ?Modern work health and safety is a shared responsibility?between?workers and employers and, now formally, the community but with the principal responsibility still remaining?with the major beneficiary of production, the business owner or, in modern parlance, the PCBU.

Darley's s obstruction of the WHS laws through the South Australia Parliament is not benefiting the people he says he is delaying the laws for, the workers. ?The delay is robbing businesses of the opportunities to apply new safety?management?practices with the support of the law and the South Australian Government. ?His constant criticism of SafeWork SA is shortsighted as the WHS laws are not about one State's OHS regulator.

Leadership is a buzzword in occupational health and safety at the moment. ?It is a concept that we should admire, trust and reward. ?Darley is not displaying leadership on the issue of the Work Health and Safety laws. ?From his speech to Parliament on 28 June 2012, it appears that he is overly influenced by the loud voices of minority business interests and his perspective is affected by an apparent animosity towards SafeWork SA. ?Neither of these issues help the workers of South Australia to be safer or businesses to be more productive and profitable.
