Parents of 'Bully' teen appeal suicide suit dismissal

By msnbc.com staff

The parents of a Georgia teen whose suicide was included in the 2011 documentary ?Bully? are appealing a judge's decision to dismiss their federal lawsuit against the Murray County school district, which they blame for his death through ?deliberate indifference? toward years of bullying.

The attorney for David and Tina Long says a notice of appeal was filed June 15, NBC station WRCB of Chattanooga, Tenn., reported.? The Longs? son, Tyler, was found dead on Oct. 17, 2009, hanging by a belt tied to a closet shelf in his room.

Tyler, who had Asperger?s syndrome, had been picked on since the fifth?grade, the Longs claimed. He was unable to comprehend certain facial expressions and body language, so kids would take advantage of him, they said.

The Chatsworth Police Department said?it would?not bring any criminal charges for events leading up to Tyler's?death, WRCB reported?in 2009.??

The Longs in 2010 sued the school district and the principal of Murray County High School in Chatsworth, claiming Tyler killed himself because school officials failed to protect him from the bullying even though middle school and high school administrators had been told of the harassment and of Tyler?s medical conditions.

On May 23, Judge Harold Murphy of the U.S. District Court in Rome, Ga., tossed out the suit in a 186-page ruling favoring the school district:

"Even viewing the evidence in a light most favorable to Plaintiffs, the Court cannot find that Defendants' response was clearly unreasonable, caused additional harassment, or demonstrates an official decision by Defendants not to remedy disability harassment. Under those circumstances, the Court finds that Defendants' actions do not rise to the level of deliberate indifference."

Tina Long ?told WRCB after the ruling, "We're in shock. The judge seemed to agree with us, but has dismissed the case."

The Longs this week told WRCB they are hoping to appeal, but say their ability to fight the case in court could be hampered by a lack of money.

?Based on the ruling, even if a school is aware that a student is being severely abused on an ongoing basis and fails to protect him, they are immune from liability,? the Longs said in a prepared statement. ?Parents all over the country need to know of this ruling. We, as parents, thought that the school was legally obligated to protect our kids, and we vow to try with everything that we have to make that happen."

The Longs' lawyer, W. Winton Briggs, told WRCB in a statement:

"This outrageous ruling and application of the law needs to be exposed. The decision is shocking in that the judge found that Tyler was the subject of ?severe, nearly constant bullying.' The case came to rest on the exceedingly high standard constituting Deliberate Indifference, which needs to be reformed to protect our children.?

Murray County school officials did not immediately respond to msnbc.com requests for comments.

After Murphy?s ruling, defense attorney Martha Pearson said school officials were ?extremely pleased with the result,? the Daily Citizen of Dalton reported.

The film "Bully" features a town meeting hosted by WRCB?in Chatsworth in 2009. The film also traces bullying incidents involving other families from around the United States.

The Longs also took their anti-bullying case to national television, appearing with Ellen DeGeneres on ?Ellen? in March with their twins, Troy and Teryn, who they said are still bullied at school even after Tyler?s death. ?Bully? filmmaker Lee Hirsh also appeared.

Twitter usage is up, and so is frustration, when it comes to workplace social networking

How much bandwidth is used by workplace Tweeting - and is it enough of a problem to actually be a problem? Maybe not, but that doesn't mean that it doesn't impact the workplace in other ways.

The lure of sneaking in a little social networking between tasks at your day job may seem insignificant in the grand scheme of things, but it turns out that the occasional Tweet every now and then eventually adds up to something much more dramatic; according to a new report on the use of bandwidth in work environments, while Facebook use has fallen significantly in the last six months, Twitter use has almost doubled in the same span. Apparently, that 140 character limit isn?t quite so limiting when you keep sending messages without keeping track of quite how many you?re responsible for.

The report, from computer security firm Palo Alto Networks is drawn from analysis of Internet traffic and bandwidth use at over 2,000 companies worldwide, has found that while the amount of surreptitious social networking during the workday overall has not changed in recent months, the location has. According to Palo Alto?s analysis, Facebook usage in May 2012 fell sharply from 54 percent of all social network traffic in November 2011 to just 37 percent. During that same period, Twitter?s percentage of traffic has risen from November?s 11 percent to May?s high of 21 percent.

Other significant social networks that figure in the grand scheme of social networking traffic are Tumblr, which took up around 10 percent of social network bandwidth in May, and high-profile upstart Pinterest, which had one percent of the pie.

The potential usefulness of social network during work hours ? Consider the benefits of providing employees with a place to vent frustrations without impacting the workplace, after all ? is offset by the many downsides, of which bandwidth usage is merely a small one (Surely the amount of time spent coming up with the perfect 140 character message to send to the celebrity of your choice would be more valuable in the grant scheme of things? Not to mention the potential problems if your employees use their social networking time to complain about your company, product or other employees; really, there?s a lot that could go wrong with this idea). Sure enough, In April, a survey of British companies found that 47 percent of employers were upset by the idea of their staff Tweeting on company time, with an additional 15 percent describing their attitude as ?very frustrated? (Somewhat oddly, another study found that 44 percent of British employees believed that Twitter and Facebook ?negatively impacted? the workplace).

Interestingly enough, Palo Alto Networks? report suggests that the morale problem is actually the larger problem when it comes to the trouble with Twitter and other social networks in the workplace. The report revealed that, for all the time and frustration spent on the subject, the actual bandwidth usage is surprisingly minor: Social networking amounted to just one percent of all bandwidth usage for the companies surveyed during May ? Meaning, if nothing else, that the social networks can feel proud about their small bandwidth footprint, if not the social devastation they might be leaving behind.

New Weight and Diet Plan Bariatric Surgery Tips

http://www.SmarterScienceOfSlim.com by Jonathan BailorSince the 1970's we have been told that eating less and exercising more is healthy and leads to lasting weight loss. Since then obesity, diabetes, and other diet related diseases have risen to epidemic levels, overtaken tobacco as leading cause of death in the United States, and account for over $190 billion a year in health-care spending.Consistent with these trends, but in sharp contrast to what the food, fitness, and pharmaceutical industries tell us, Jonathan Bailor's new book The Smarter Science of Slim, the single largest scientific analysis of health and fitness ever conducted, proves that eating less and exercising more harms our health and leads to fat gain 95.4 percent of the time. The Smarter Science of Slim simplifies the analysis of over 1,100 scientific studies to bridge the gap between the scientific world and the everyday world, dispel the myths and marketing that have fueled the current health care crisis, and provide a proven lifestyle for lasting wellness by focusing on quality of food and exercise and then eating more and exercising less ? but smarter. The Smarter Science of Slim is endorsed by the world-wide scientific community including top doctors at the Harvard Medical School, John Hopkins, and UCLA, and approved as curriculum for registered dieticians (RDs) by the Academy of Nutrition and Dietetics. "We all know what the typical approach leads to," remarked Bailor who is confident that the last forty years of research from the most brilliant medical minds around the world prove that we can use this atypical "eat more, exercise less?but smarter" approach to generate atypical results: improved health and reduced obesity and diet-related disease rates. While working as a personal trainer Bailor experienced firsthand how ineffective traditional approaches to health and fitness were. While his clients would achieve the results they wanted as long as they trained for an unsustainable amount of time with Bailor, without constant coaxing to "eat less and exercise more," they would inevitably harm their health and gain back more weight than they lost. The disappointing long-term results he was delivering to his clients made Bailor determined to find a more sustainable approach.???????Benefits???????Lower your risk of diabetes, heart disease, cancer, and cardiovascular diseaseLose body fatImprove cholesterol and blood pressureAvoid hungerEnjoy higher energy levelsImprove confidence and self-esteemIncrease insulin sensitivity and control diabetesCurb cravingsEnd overeatingGet sick less oftenImprove complexion and skin toneBoost your ability to concentrate and moodSleep better and feel more restedEnhance strength, fitness, cardiovascular health, and athletic performanceEnjoy less anxiety and depressionImprove sexual performanceReduce chronic pain and arthritisSpeed-up metabolismImprove estrogen and testosterone levelsDevelop compact lean muscle tissueEnhance bone densityIncrease regularityDecrease desire for cigarettesReduce age-related vision loss???????Reviews???????"Dismantles the myths that have contributed enormously to our health problems, and replaces them with simple facts."Dr. JoAnn E. rambling thoughts on identity, relationships, and fan fiction - Yes

For the past few weeks, I've been thinking a lot about how we, as a culture, conceptualize identity -- particularly sexuality?as part of identity -- and how it relates to our real-life experiences in relationships: how our understandings of self shape the possibilities we see for relationships, how relationship experience shapes our notions of identity, and what stories we tell each other about how sexual identity and relationship inform one another.

These aren't new thoughts for me, but being engaged to Hanna -- planning our marriage, talking to other people about the cultural and personal meanings of marriage -- brings me back once again to the twin topics of identity and relationship. Being engaged -- actively defining our relationship to the outside world -- also prompts me to notice more keenly the stories we tell, as a culture, about sexual identity and relationships. In this instance, the way in which sexual identity and relationships are theorized in erotic fan fiction (which, many of you know, I read?regularly and passionately).

There's a lot of fic out there in which character X discovers they are attracted to character Y who is of the gender they didn't think they had the hots for and ohmygod identity crisis ensues! This is a plot/relationship narrative that -- just like any other dramatic tension -- can be handled really well or handled really poorly. But I'm less interested in the deftness, in this instance, than I am in the assumption that experiencing desire for someone of an unexpected [insert identity characteristic here] stops the desiring character in their tracks because their feelings of attraction don't match up with their self-understanding.

On the one hand, I completely understand that sometimes, falling in love "against type" so to speak precipitates re-evaluation of who you thought you were or what it is you understand yourself to desire.?I won't lie: falling in love with Hanna required (or at least prompted) me to think more seriously than I had before about how my sexuality worked. I've written about this in the past (see here, here, and here). Sexuality is one thing in the singular, another thing in the relational.?

So, yeah, there was adjustment.?

But here's the thing that I've been thinking about lately: my sexual identity?in the abstract was most urgently important before?Hanna and I were actually in a relationship. I worried about how to convince her with evidence?that no, really, I thought she was hot. I worried about what might count as evidence of same-sex desires in the past (which, in turn, could be brought forth in support of a pattern?into which?Hanna-desires fit neatly, rather than being the exception to the rule). I worried about whether I was worrying too much about marshaling the evidence and therefore reading back into my personal history sexualized feelings that hadn't been there at the time ("did I like?her, or like-like her?").

Basically, I worried a lot.

There was massive?angst.

I wrote my own life into an angsty, identity-crisis fic to which, appropriately enough, there was ultimately a solution in the form of sexytimes.*

Here's the "on the other hand" thing, though. The moment -- and I'm talking the moment?-- we touched in a way that undeniably conveyed to each other "I want to get in your pants as quickly as possible"?

Worry totally?gone.

In that moment, I had absolutely all the evidence I needed that whatever-and-whoever-the-hell-else I might be interested? I was interested in Hanna.

End of story.

Well, okay, not totally end of story. 'Cause within that story I got to think a lot?about what sex meant to me, and what I enjoyed, under what circumstances, the space between fantasy and real-world interaction, all of that. It's an ongoing conversation. And a really hot one.

(Have I mentioned intellectual stimulation is a turn-on for me?)

But?the question of identity?became kinda ... irrelevant. Actually, super-irrelevant. Because no matter what I chose to identify?as, whatever I called myself, in whatever contexts I named myself, in practice?I was Hanna-sexual. As in, sexually attracted to Hanna. All the other attractions I may or may not have moved into the realm of "theoretically interesting but not that practically relevant."

Because I could have said I was doorsexual and still?when I put my hands on Hanna I would have wanted her.

And in my book, experiential evidence trumps theory every time.

So when I read these fics in which character X is enjoying sex with character Y -- and I mean seriously?enjoying sex -- yet simultaneously freaking out because this isn't sex they should?be enjoying? I think about the issues we've created for ourselves by imagining that sexuality and sexual identity is the quantifiable, identifiable, constant thing.

That we can, that we should, understand?what we want prior to actually having it, prior to coming across it in the wild, this beautiful, breath-taking being in our path. Prior to knowing and being known, in that moment of intimacy, of home-coming (or, conversely, that moment of escape-from-the-body, of clarifying distance; sex is, after all, what we make and want of it).

What I'm saying is: Aren't we simply what we are?

And if we stumble into love, into desire, into oh god you feel amazing under my hands and please never stop touching me there?does it really matter so frickin' much to our notion of the self whether or not the body, the person, in question is the same shape as the last body, the last person, who felt this way under, within, around us?

At what point in our history did the body of others?become so central to the constitution of ourselves? Because that's how the think of sexual identity these days -- it's about the self, yes, but it's about the self in relation to?the bodies that one finds desirable. It constitutes the self in some pretty fundamental ways but pre-emptively narrowing?who we imagine ourselves capable of getting down and dirty with.

As I type this, my internal antagonists are arguing with the words on the page, pointing out how much all of this is colored by my subjective experience of fluid, person-centered sexual attractions, and my claustrophobic reaction to closing doors of possibility when there's no imminent need to do so. So obviously this is only my own particular reaction and all, but really ... why do we make it so difficult?for ourselves?

Wouldn't it just be easier if instead of an existential crisis, falling in love with an unexpected person was more like, "Oh, you mean I like this too? That's cool."

*Someday, maybe I'll write it into an actual?smutty fic. Hanna and I keep threatening to do this in turns, but so far neither of us has made the time to follow through and do it.

Autoresponders Generate Online Profits ? SMB Advice & Tips

by: Lewis Leake

If you ask online marketer how to convert website visitors into buyers,

most will give you the same answer: the sales are in the follow-up.

It?s much more than just increasing your traffic volume. After all, most

of your visitors won?t decide to purchase your products or your services

when they first visit your website. But that?s not to say that they won?t

be interested in your offer tomorrow or next week, or that they won?t be

interested in future offers.

Therefore, it is necessary to get your visitor?s email addresses so that

you can inform them of current and upcoming offers. You do this by using

an opt-in system that invites them to subscribe to your mailing list. By

gathering their names and email addresses, with their permission of

course, you are now able to contact them periodically with information,

usually by sending them an ezine as well as an occasional freebie.

There are no problems as long as you?re only dealing with ten or twenty

subscribers, as you could just email them individually. However, such

numbers aren?t going to make you many sales. You should aim for a mailing

list that could reach into the thousands. That number of subscribers

would make it difficult for you to prepare individual emails for each

name on your list.

The basis of an ideal mailing list, therefore, is an effective

autoresponder system that provides the power and flexibility to email

your subscribers in a timely and efficient manner.

A mailing list of considerable size powered by a good autoresponder

system consistently provides earnings for many Internet marketers. A lot

of online businessmen make significant profits from their mailing lists

alone.

Okay, but what is an autoresponder system? An autoresponder system is

like a digital secretary. It takes care of your subscribers by providing

an opt-in system that allows visitors to subscribe to your mailing list.

An autoresponder system also takes care of the sending of emails to your

subscriber base.

You can prepare your messages in advance, program them into the

autoresponder, and preset the intervals by which the messages are

delivered. You can even separate your subscribers into various groups.

You could have a group for those who have not yet placed an order, for

example. You could have another grouping for those who have already made

a purchase. This allows you to use two different marketing approaches in

dealing with each of the groups.

A good autoresponder system can help you build trust in your products or

services. With a good autoresponder, you can also provide an efficient

technical support program. If your subscribers email you a question about

one of your products, for example, you could preset the autoresponder to

reply with a general FAQ to send them the information.

Not all autoresponders are designed the same and much care should be

taken in choosing the right one for your particular needs. Here are some

questions you should ask before you decide on a particular autoresponder

service:

* How many accounts can you create? Some business plans might

require that you have different accounts for different products.

* How many lists can you build? There are also some business plans where

you might need different lists for different groups of subscribers.

* How many follow-up messages can you preset? Do you need a lot of

follow-up messages or do you know yet? Quite a few autoresponder services

provide for unllimited follow-ups.

* How many subscribers can the system hold? And also, how many

subscribers can the system respond to?

* How much customization is allowed? You need to be able to personalize

your email messages with each subscriber?s name and other customizable

information.

* How does the system gather subscriber information? The process should

be simple and convenient; otherwise, the visitor will not subscribe.

* Will you be able to send your messages in html and text formats? Most

autoresponder services allow both formats.

* Will you be able to track your subscribers for the purpose of target

marketing? This my or may not be important to you.

* Is the scheduling system fully automated and flexible enough for your

current and future needs?

* Is the autoresponder easy to use? Do they have a demo area so that you

can try it out?

Now, does the autoresponder service you are considering provide answers

to all of the above questions? If so and if it is offered at a reasonable

price, then you should grab the deal as soon as you can.

Remember, if you?re running an online business, a good autoresponder

should be one of your primary investments. It could be the key to an

excellent conversion rate, more sales and more profits.

Novel Catalytic Function of MUC1 for the Development of Cancer Therapeutics (TID-242)

This newly discovered function of MUC1 presents a novel target for the development of new cancer therapies and diagnostics.

MUC1 is a membrane bound mucin protein that is overexpressed in 90% of epithelial carcinomas.? Due to its overexpression in a wide variety of tumors, MUC1 is considered an ideal target for the development of new diagnostics and therapeutics.? Researchers at the University of Nebraska Medical Center recently discovered a new function of MUC1.? Research led by Dr. Michael Hollingsworth has identified a ubiquitin interacting motif common to E2-ubiquitin conjugating enzymes within the C-terminal fragment of MUC1.? They have demonstrated that MUC1 is conjugated to ubiquitin via a cysteine residue only in the presence of an E1 enzyme and they have identified potential targets for MUC1-regulated ubiquitylation, such as the transcription factor c-Jun.? The development of inhibitors against this newly discovered E2 active site within MUC1 could become useful therapeutics for the treatment of cancer.? Furthermore new diagnostics can be developed for ubiquitinylated forms of MUC1 and targets of ubiquitinylation of MUC1, which would be extremely useful for cancer prognosis, monitoring cancer progression, and identifying appropriate therapeutic strategies.

(AP) ? President Barack Obama's health care overhaul is on the way to its ultimate jury: the families, doctors, business people and state officials who'll have to grapple with the confusing details while striving to fulfill its promise.

With the Supreme Court hurdle cleared, open enrollment for millions now uninsured is scheduled to begin 16 months from now, in October 2013. Much of the health care industry is ready. People who do have insurance won't have to worry about the loss of popular new benefits, such as coverage for young adult children or improvements to Medicare's prescription plan.

And, starting in 2014, insurance companies will no longer be able to turn away people with a history of medical problems, or charge them more.

But carrying out the law will be a mad scramble for states, especially Republican-led ones where officials had hoped this day wouldn't come. And the court added a new complication by giving individual states more leeway to turn down the law's expansion of Medicaid, expected to provide coverage to about 16 million uninsured people.

After the ruling, chances of repealing the entire law appear much slimmer for Republicans, although they will again make it an election rallying cry. However, a targeted repeal strategy aimed at individual components of the law including cost controls, taxes and spending cuts, may still work.

Vicki McCuistion of Driftwood, Texas, who shuttles between two part-time jobs and is uninsured, said the Supreme Court ruling has given her new hope. Her husband Dan has back problems so bad he can't go to work some days, and with a family history of skin cancer she is worried about a mole that she hasn't been able to get checked by doctors.

"Having access to health insurance that we can actually afford would allow us to improve our lives," McCuistion said Thursday.

At the White House, Obama repeated his promise that the Affordable Care Act will both deliver health insurance and help get a handle on growing costs. But the glow of victory may be brief. Even some supporters of the law candidly admit it's only a first installment ? a way to get most of the population covered before tackling costs forcefully. Wrenching choices about Medicare and Medicaid cuts could come as early as next year.

Thursday's decision moves the United States closer to other economically advanced countries that for years have guaranteed health insurance to their citizens.

The law's controversial mandate that individuals have health insurance or pay a fee ? upheld by the court on Thursday ? will affect relatively few people, because more than eight in 10 Americans already have coverage. But employers with 50 or more workers will face fines if they don't provide insurance for employees.

The law is expected to extend coverage to about 30 million of the estimated 50 million uninsured. Illegal immigrants will represent a large share of those still without coverage, but 90 percent of citizens and legal residents will have insurance.

The focus now quickly shifts from Washington to the states.

While health insurers, big hospitals and major employers have spent the last two years planning and carrying out the law, states are all over the lot.

Although they are expected to play a crucial role in delivering insurance to their residents, only 14 states, plus Washington D.C., have actually adopted a plan for doing so. Hoping the law would be overturned, Republican governors and legislatures have resisted setting up new insurance markets that are a linchpin of the legislation, and that could turn into a problem for the whole country.

The National Association of Insurance Commissioners expects only about half the states to be ready to set up new health insurance markets, slated to open for business on Jan. 1, 2014.

If states aren't ready, the law calls for Washington to step in and run things. Health and Human Services Secretary Kathleen Sebelius says the feds are ready to do that.

State plans for the markets ? called exchanges ? are due to the federal government this fall. Washington will run the exchanges in states that lag behind. The new Internet-based markets are supposed to provide one-stop shopping for health insurance, steering middle-class households to private plans and low-income people to an expanded version of Medicaid, the federal-state program for the poor and disabled.

But the court added a new wrinkle, ruling that states cannot be threatened with the loss of their entire Medicaid allotments if they refuse to carry out the expansion, which is geared largely to helping uninsured low-income adults. Under the law, the federal government will pick up all of the cost for the first three years, eventually dropping to a 90 percent share.

Matt Salo, head of the National Association of State Medicaid Directors, said it's too early to tell what states will do.

"This opens up what was a mandate into a state option, and states are going to have to think very, very carefully as they weigh all the political, policy and fiscal ramifications of the decision," Salo said.

States that turn down the money will still be stuck with the cost of treating uninsured patients in hospital emergency rooms. States that accept the money may be on the hook if Washington later decides to reduce the generous federal matching funds for the expansion.

"What this really means is the decisions are going to be made after the elections this year," said Wisconsin's health secretary, Dennis G. Smith, whose state has not moved to put the law in place. "This is going to go back to Congress. We had always thought (the law) was unworkable, and today's ruling proves the point even more."

Aside from help for low-income and uninsured people, the Supreme Court decision also means an expanded safety net for all Americans. Starting in 2014, insurance companies will not be able to deny coverage for medical reasons, nor can they charge more to people with health problems. Those protections, now standard in most big-employer plans, will be available to all, including people who get laid off, or leave a corporate job to launch their own small business.

Seniors stand to receive better Medicare coverage for those with high prescription costs, and no copayments for preventive care. But hospitals, nursing homes, and many other service providers may struggle once the Medicare cuts used to finance the law really start to bite.

The health insurance industry's top lobbyist said the ruling relieved one big concern for insurers ? that the mandate would be struck down, allowing people to buy coverage literally on the way to the hospital. But the companies are still worried about costs.

"Without universal participation you have no incentive to purchase coverage until you are sick, and that is not an insurance system," said Karen Ignagni, president of America's Health Insurance Plans. "Now it's time to turn all the attention toward affordability." The industry continues to fight taxes and other requirements in the law.

In contrast to the states, the nation's vast health care industry is better prepared. When the law passed in 2010, insurers, hospitals and major employers immediately went to work to carry it out. Some of the changes called for in the law were already being demanded by employers trying to get better value for their health insurance dollars.

"The factors driving health care reform are not new, and they are not going to go away," said Dr. Toby Cosgrove, CEO of the Cleveland Clinic. "We know we have to take costs out of the system and improve quality."

Burnett, Pirates top Phillies

By ROB MAADDI

PHILADELPHIA (AP) - A new catcher didn't affect A.J. Burnett's groove.

Burnett threw 6 2-3 sharp innings to win his eighth straight start, Casey McGehee hit a three-run homer and the Pittsburgh Pirates beat the Philadelphia Phillies 5-4 Thursday.

Pedro Alvarez also went deep for Pittsburgh, which split the four-game set in Philadelphia by winning the last two. The surprising Pirates, seeking their first winning season since 1992, are 40-35 and second in the NL central.

Burnett (9-2) allowed three runs and six hits, striking out seven. The winning streak is his longest, and it's the first time a Pirates pitcher has won eight in a row since Dock Ellis in 1974.

Michael McKenry caught Burnett for the first time because starter Rod Barajas is injured.

"I was really impressed with McKenry," Burnett said. "He was outstanding. I can't say enough about him. It was a pleasure to work with him. He picked up where Rod left off."

Joel Hanrahan tossed a scoreless ninth for his 20th save in 22 tries. He retired Hunter Pence on a shallow fly with the tying run on third to end it.

Eric Kratz and Pence hit homers for the Phillies.

The Pirates jumped on Kyle Kendrick (2-8) for five runs before he recorded a second out in the first.

"Gave us a chance to win, pitched deep into the game, which they needed me to," Kendrick said. "We came up short."

Drew Sutton led off with an infield single and Neil Walker walked. One out later, Garrett Jones hit an RBI single. McGehee followed with a three-run shot to left. Alvarez then lined one out to right to make it 5-0.

McGehee has five homers and 15 RBIs in June after driving in just six runs with no homers in the first two months.

"I think at one point I was trying to do too much," McGehee said. "I was with a new team trying to make a good impression. Then I went back to just trying to hit the ball up the middle of the field."

Kratz connected off Burnett in the second to cut it to 5-2.

Burnett retired nine straight before consecutive singles by Shane Victorino and Pence put runners on first and third with one out in the sixth. Placido Polanco's fielder's choice grounder scored Victorino to cut it to 5-3.

Pence led off the bottom of the eighth with a shot off Jason Grilli for his first homer since June 2 and 14th of the year. Pence snapped a 98 at-bat homerless drought.

Grilli pitched out of a jam with two runners on to preserve the lead. He struck out pinch-hitter Jim Thome and retired pinch-hitter Carlos Ruiz on a foul pop. First baseman McGehee made a nice running catch and held onto the ball after stumbling into the first row down the right-field line.

"We got some tough outs from Grilli and Joel," Pirates manager Clint Hurdle said.

Kendrick settled down nicely after the awful start. He gave up five runs and six hits in seven innings.

This was Burnett's first appearance in Philadelphia since losing to Cliff Lee and the Phillies in Game 5 of the 2009 World Series. Burnett beat Pedro Martinez in Game 2 that year and the New York Yankees prevented the Phillies from repeating as world champions by taking the Series in six games.

The Phillies finished 5-5 on their longest homestand of the season. The five-time defending NL East champions fell to last place and are 36-42, including 17-24 at home.

NOTES: Phillies designated RHP Chad Qualls for assignment and called up RHP Brian Sanches and LHP Jeremy Horst. ... 1B Ryan Howard is set to start a rehab stint at Class A Lakewood on Thursday night. The 2006 NL MVP hasn't played for the Phillies this season after tearing his left Achilles' tendon last October. ... Burnett is 6-0 on the road. ... The Pirates went back-to-back for the third time this season. ... The Phillies had their 261st straight sellout, including postseason games. ... Lee (0-4, 3.72) tries again for his first win when the Phillies open a three-game series in Miami on Friday night. ... Kevin Correia (3-6, 4.03) starts for the Pirates in St. Louis on Friday.

BETHLEHEM, West Bank (AP) ? The Palestinians on Wednesday made a final push to have UNESCO recognize the Church of the Nativity in Bethlehem in the Israeli-controlled West Bank as an endangered World Heritage site, despite misgivings by Christian denominations and a cool response from the U.N. agency.

The Palestinians acknowledge a political component to their bid, saying UNESCO recognition of the centuries-old basilica, built over Jesus' traditional birth grotto in the biblical town, is also a vote for an independent Palestine. Israel says the Palestinians ? by claiming one of Christianity's holiest sites is threatened by Israel's occupation of the West Bank ? are bashing the Jewish state.

A decision is expected in days at a meeting by a UNESCO committee in St. Petersburg, Russia. Two Palestinian officials said they count on support of at least 10 of 21 countries represented, and hope for a win if enough members abstain.

The World Heritage campaign is part of a Palestinian drive to win international recognition, as attempts to establish a Palestinian state through negotiations with Israel are frozen. Talks broke down in 2008, and Israeli and Palestinian leaders disagree over ground rules for renewing them.

Palestinian President Mahmoud Abbas is trying to boost his leverage by seeking world recognition of a state of Palestine in the West Bank, Gaza and east Jerusalem, territories Israel captured in 1967. His quest for U.N. membership has stalled. However, last year, the Palestinians won member state status in UNESCO, over the objections of Israel and the U.S., which withdrew $80 million in annual dues ? 22 percent of the overall budget ? from the organization.

Abbas' Palestinian Authority, which has partial control in 38 percent of the West Bank, hopes to win World Heritage recognition for 20 sites. Bethlehem, seen as the most promising candidate with its emotional appeal to millions of Christians worldwide, was submitted first.

The nomination process takes about 18 months, but the Palestinian Authority fast-tracked the nomination of the Church of the Nativity and the ancient pilgrimage route leading to it by declaring them endangered. A UNESCO experts committee has dismissed the claim of an imminent threat and suggested the Palestinians go the regular route, but the Palestinians refused.

On Wednesday, Palestinian officials took journalists on a tour of the church, adjacent Manger Square and the pilgrimage route along Star Street to make the case for urgent U.N. protection.

They argued that the area was damaged by Israel in the past, including during Israel's 2002 reoccupation of the West Bank when tanks rumbled through Bethlehem's alleys, part of a crackdown on Palestinian militants involved in attacks on Israelis. At that time, Israeli soldiers surrounded the church for more than a month in a standoff with Palestinian gunmen holed up inside.

Since then, Israel has also built a separation barrier ? it claims to keep out militants, while the Palestinians say it is a land grab ? and Bethlehem is now blocked on three sides by walls and fences.

The basilica is also in need of restoration, particularly fixing a leaky wooden roof, but the Palestinian Authority has been able to raise only $3 million of $20 million pledged by foreign donors. A nod from UNESCO could help raise the money, but this is not a primary consideration, officials said.

"The city and the Nativity Church are in danger because of the Israeli occupation. It is not only a question of restoration or renovation," said Omar Awadallah, a Palestinian Foreign Ministry official.

Israeli Foreign Ministry spokesman Yigal Palmor said Israel supports the designation of the basilica as a World Heritage site in principle, but he denies the church is endangered.

The Palestinians "tried to politicize the debate by presenting the church as being endangered, which implies Israel is to blame," said Palmor. "The church will be listed in due time ... but UNESCO does not find any justification that the church is in danger, and the Palestinians cannot use this to ram Israel."

Awadallah alleged that Israel and the U.S. lobbied the committee members to reject the bid, which he portrayed as a vote on Palestinian independence.

Debate begins Friday, and a vote is possible by the weekend, Palestinian officials said.

In the run-up, the Palestinian Authority has scrambled to bring on board the Roman Catholic, Armenian and Greek Orthodox churches which share responsibility for the basilica. The three denominations jealously guard their roles as custodians, assigned to the last brick by a document going back to 1852 during Ottoman rule and known as the Status Quo.

The churches fear meddling by the U.N. and the Palestinian Authority if the church gets the World Heritage label, and church officials have expressed their misgivings, to the embarrassment of Palestinian officials.

A PLO official said Wednesday that the goal is to persuade church officials not to express their concerns in public before the vote.

Awadallah and other Palestinian officials denied church leaders were still opposed.

Church officials who expressed their opposition last week could not be reached for fresh comment Wednesday.

NBA Draft 2012: Of Darko, Greg Oden and the Scariest Moment in Professional Sports

There is no scarier moment in professional sports than tonight around 8 pm when NBA Commissioner David Stern will shakes hands with a very tall young man in a flashy suit and a commemorative baseball cap. At least if you?re an NBA GM and that young man is about to become the highly-paid employee upon which your future rests.

Why do GMs have nightmares about Draft Day? Here?s Exhibit A:

?He?s going to own the game. Own the game. We?re going to have to build a new arena. The only thing that could destroy a kid like that is a woman. I?ve seen a lot of kids come through here in my day. And none of them have ever played like that. That kid?s going to be a star. He?s a 7-footer that plays like a point guard. That kid?s something special.?

The guy making those lofty pronouncements? Detroit Piston scout Will Robinson, who found future All-Stars Joe Dumars and Dennis Rodman when they were diamonds in the rough.

About whom was he enthusing?? Darko Milicic.

In the 2003 NBA Draft the Pistons owned the number two pick, and passed on Dwyane Wade and Carmelo Anthony to pick the Serbian power forward so talented that a few pundits thought that Cleveland should take him with the first pick instead of LeBron James.

It wasn?t a woman who destroyed Milicic. Just a lack of NBA skills and commitment. His career stats: 6.0 points per game, and 4.2 rebounds

But Robinson was hardly alone. ESPN?s Chad Ford was equally effusive in his praise of the young Serbian.

?Darko is really one of a kind. He runs the floor, handles the ball, shoots the NBA 3 and plays with his back to the basket, so you can slot him in at the 3, 4 or 5 positions. OK, a few other guys can do that too; what sets Darko apart is his toughness in the post.?

Welcome to the world of the NBA Draft. Where? else in the world of business does a top manager have to make a decision so important, so public, and with so much possibility for it blowing up in his face?

Indeed,Darko was not even the most legendary draft day bust of the last decade. That honor would go to Greg Oden of the Portland Trailblazers.

?You can see why he?d be a No. 1 pick. I think he?s one of the best centers to come out of college. He?s quick and agile, he?s 7-feet, 250. I?ve never seen that in a center before.?

Oil above $80 amid signs of improving US economy

SINGAPORE (AP) ? Oil hovered above $80 a barrel Thursday in Asia amid signs the U.S. economy, the world's largest crude consumer, may be improving.

Benchmark oil for August delivery was up 10 cents at $80.31 a barrel at late afternoon Singapore time in electronic trading on the New York Mercantile Exchange. The contract rose 85 cents to settle at $80.21 in New York on Wednesday.

In London, Brent crude for August delivery was down 40 cents at $93.10 per barrel on the ICE Futures exchange.

On Wednesday, the U.S. said durable goods orders rose by 1.1 percent in May, reversing a two-month drop. Pending home sales also jumped in May.

Crude has plummeted from $106 early last month on expectations weak global economic growth will drag down oil demand. Some analysts expect crude to hover near $80 until U.S. demand picks up.

"This is the longest and slowest recovery from double digit unemployment ever" for the U.S., said Carl Larry of Oil Outlooks and Opinions. "Prices are going to be a fair value for producers and consumers around $80."

Investors will be eyeing a two-day European Union summit scheduled to start later Thursday. While most analysts don't expect E.U. leaders to announce a major policy initiative, traders will be closely watching for signs of progress toward a solution to the region's debt and economic woes.

Signs of a weakening Chinese economy have also dragged oil prices lower. Citigroup estimates China will account for about half of global oil consumption growth this year.

"While Europe concerns impact all asset markets, the slowdown in China is particularly daunting for commodities," Citigroup said in a report.

However, the recent drop in fuel costs should help Asian economies by easing inflation pressures and giving policymakers more room for fiscal and monetary stimulus measures.

"In general, cheaper oil is in itself a good thing for Asia," Capital Economics said in a report. "The trouble is that oil prices are falling because the global economy is getting weaker. This means that instead of pushing up Asian growth, lower oil prices will only cushion the downside."

In other energy trading, heating oil was down 1 cent at $2.58 per gallon while gasoline futures slid 0.6 cent at $2.49 per gallon. Natural gas added 2.9 cents at $2.83 per 1,000 cubic feet.

Accrington artist's painting goes onto silk Paul Smith scarves

AN artist has been discovered after painting an iconic Hollywood building.

The retired criminology Professor John Tierney, from Accrington, was visiting his son in the USA, when he decided to indulge in his hobby of painting when in the famous shopping distict of Melrose Avenue.

The hot pink designer store on Melrose, where British designer Paul Smith is based in LA, immediately caught his eye.

Within months the painting was a hit, and the design had been copied onto silk Paul Smith scarves, which sold out instantly.

And following an exhibition of John?s work at the LA Paul Smith store, there are now talks of exhibitions in Tokyo and London.

John is also in talks with Paul Smith to discuss a contract about using his images on other items of clothing in the future.

The 67-year-old has no formal art training and is entirely self taught.

A former Holy Family Secondary Modern pupil in Fern Gore, he said he loved art at school.

After school he began an engineering apprentice-hip in Burnley as a draughtsman preparing technical drawings. In his early 20s he chose a different path and began university.

Ultimately he became a criminology professor, retiring from Durham University in 2010, when his art hobby began to really flourish.

He said: ?I just really enjoyed painting in LA. The light is amazing and the colours are strong and sharp against a blue sky. I just love it. I didn?t expect Paul Smith to see the paintings but my son, who lives in LA, was an acquaintance of his and he got to see them.

?The next thing I knew they had been turned into silk scarves. That was a very fun process and they did an amazing job reproducing my painting.?

Two hundred people attended the Hollywood oil painting exhibition, of American urban and desert scenes, including actors Josh Duhamel and Mira Sorvino.

The success of the exhibit has been featured in American art publications in which John has been likened to David Hockney and Edward Hopper.

John added: ?It?s really exciting and a complete surprise. I never expected my hobby to one day be more successful than my main career.?
