iPad app helps student communicate | eSchool News

9-year-old Anastacia Marquez communicates more precisely and efficiently now, thanks to a specialized application on a school iPad called Proloquo2Go.

?Want to go and do science??

Anastacia Marquez, a 9-year-old student at Sunrise Elementary School in Las Cruces, N.M., pauses for a beat, pondering the question from one of her teachers, Melissa Flavell.

Marquez extends her left index finger, and presses the corresponding answer on her iPad: ?Yes.?

It?s a simple exchange between student and teacher?one that was more difficult a few months ago.

Marquez has lived with multiple brain tumors since she was less than a year old. Those tumors?there are now five?and the seven neurosurgeries she has endured silenced her speech. Through a combination of mouthing and whispering, Marquez can identify many letters of the alphabet, and their corresponding sounds. But her ability to communicate verbally is significantly limited.

?When she?s happy, we know she?s happy,? said Sunrise principal Brian Peterson, who said Marquez beams at music class. ?But the poor squirt isn?t always happy ? She?s been through a lot, and we don?t always know how to help.?

Thanks to Peterson?s love of gadgets, dedicated work by Sunrise staff members, and a popular piece of technology, that?s starting to change.

Marquez communicates more precisely and efficiently now, thanks to a specialized application on a school iPad called Proloquo2Go. Teachers can ask Marquez direct questions, and she answers by pressing an icon on the iPad?s touch screen.

The device is the property of Sunrise Elementary, but Marquez carries it home so she can take advantage of the enhanced communication ability it provides.

Maria Marquez, 10, is one of Anastacia?s three sisters. She also attends Sunrise Elementary. Maria said Anastacia used to communicate primarily with nods?or by patting her head when it ached.

That?s different now.

Victorinox Swiss Army Slim Flight

Portable storage can take many forms, but here's a flash drive that's a dead ringer for something you might already carry?the Swiss Army knife on your key ring. The Victorinox Swiss Army Slim Flight (4GB) ($40 street) is a small, lightweight USB flash drive with an attractive design and a potent software package.?Although it may not be the cheapest drive you'll find, it's easily one of the finest looking.

Design
The Slim Flight (4GB) lives up to its Swiss Army name, with a handsome pocket knife?style swiveling cover, complete with an integrated clip to secure and easily open the drive. No larger than a traditional Swiss Army keychain pocket knife, the cover of the slim USB drive is metal, with a textured surface and the Swiss Army logo. Our review unit came in silver, but other colors?orange, pink, green, and blue?are available. The cover has a handy locking mechanism to keep the drive closed while it rattles around in your pocket or luggage, and the drive can actually be removed from the cover and swapped out for one with?more memory without your?having to purchase the entire product over again.

The "Flight" moniker comes from the fact that there is no knife component to this Swiss Army flash drive. Other models include a folding blade, but anyone who regularly deals with the TSA knows that you don't want your data to be confiscated at the airport.

The drive is also very slim, measuring 0.3 by 0.6 by 2.3 inches (HWD)?the same size as a keychain Swiss Army knife?and weighs only 0.4 ounce. No worries about blocking other ports when using the drive?this USB device is about as small as it gets.

Despite the small size, you'll be getting anywhere from 4GB to 64GB of storage capacity, with models ranging between $40 (for the 4GB model) to $225 (for the 64GB model). Our review model, the 4GB version, costs $10 per gigabyte, which is pricey, to be sure. The cost per?gigabyte lowers as the capacity?increases, with the 64GB model coming out to roughly $3.51 per gigabyte.

Features and Performance
The Slim Flight (4GB) comes with some software preinstalled, courtesy of Victorinox. The software includes encryption tools, zero-footprint anonymous browsing, password management, and automatic file backup. These sorts of tools are invaluable when travelling for business, where you may be separated from your laptop or don't have consistent access to any one PC. Unfortunately, these tools are Windows only.

Setting up the encryption is simple, but it does involve a few minutes and multiple steps, so be prepared to spend some time with the installation wizard. First you set up a password for the drive. Next, you have the option of creating an encrypted partition on the drive. When you set up the encryption, the wizard includes a slider that lets you choose how much of the drive you want to encrypt. You can choose anywhere from the full capacity of the drive to as little as 10MB.

The software also includes options for Internet browsing, letting you either sync your favorites and bookmarks between multiple computers or browse safely on any system. The safe browsing mode opens up its own copy of Internet Explorer in "no trace" mode which, as the name implies, leaves no traces of your browsing on the PC. The safe browsing utility also lets you delete the history, cookies, favorites, and temporary files of either the local Internet log files or the USB-based browser. Extending the online communication tools further, there's also a tool to back up and sync your Outlook files to and from the USB drive.

In performance tests, the Swiss Army Slim Flight scored 631 points in Futuremark PCMark 7's storage benchmark, slightly ahead of the Kingston DataTraveler Locker+ (8GB) ($14 street, 4 stars), which scored 623. Despite the slightly better performance, and identical read speeds (24.52 MBps), the Victorinox Swiss Army Slim Flight has a slower write speed. In our timed test transferring 4.93GB of data, the Slim Flight had a write speed of 5.82MBps, while the DataTraveler Locker+ pulled ahead with a speed of 9.65MBps.

All in all, the Victorinox Swiss Army Slim Flight is the sort of drive you want to buy if you aren't worried about losing your flash drive. It's attractive, but not too bulky to carry on your key ring. It's filled with goodies like bookmark syncing, password management and easy to use encryption. It's also a bit more expensive than generic drives, without being dramatically faster. It's a smart buy, but you'll pay for what you're getting.

US preparing for military intervention in Syria? | End the Lie ...

The US and other NATO countries could soon launch a ground assault on Syria. The final decision will be made soon, following this week?s Tunis conference where allied countries will meet to discuss possible scenarios of military intervention.

Sources in Washington tell Israeli news agency Debka that the Pentagon is currently drafting the approach they want America to take in the Syria ordeal, and once it is ready for the president, Obama could approve military action. Debka adds, however, that the decision will also depend on what US Secretary of State Hillary Clinton takes away from this week?s Tunis conference.

Representatives from 80 countries across the glove are expected to descend on Tunis on Friday under the name ?Friends of Syria.? Should Saudi Arabia, Egypt, Qatar and the UAR support a western intervention in Syria, Clinton could offer an endorsement to the Pentagon, who will in turn finish their draft for war plans and send them to the White House for approval. According to Debka?s sources, UK, France, Italy and Turkey also prepare to send their troops into Syria.

Earlier this month, President Obama seemed to side more with a solution that would save the US from directly dragging itself to war. ?I think it is very important for us to try to resolve this without recourse to outside military intervention. I think that?s possible,? the president told NBC News.

Elsewhere in Washington, some representatives have already openly endorsed aiding the Syrian rebels. Speaking from Kabul, Afghanistan last week, Senator John McCain insisted that the US could offer support to the opponents of Assad without necessarily sending troops of their own over.

?People that are being massacred deserve to have the ability to defend themselves,?said McCain, who added, ?I believe there are ways to get weapons to the opposition without direct United States involvement.?

As RT reported earlier, FBI whistleblower Sibel Edmonds said she believes that American forces in conjunction with NATO have already been training Syrian revels since May 2011 in the Turkish city of Hakkari. Upwards of 10,000 Libyans are also believed to being trained nearby to assist in nearby Jordan.

Senator Lindsey Graham provided more information recently on America?s interest in toppling the Syrian government. He also this month advocated for the aiding of rebels, saying that a US intervention to remove al-Assad would assist in hurting Iranian interests in the region.

?If the Syrian regime is replaced with another form of government that doesn?t tie its future to the Iranians, the world is a better place,? said Graham.

In America on Wednesday, the four remaining GOP frontrunners for the presidency also discussed the Syrian dilemma, largely avoiding any direct response while instead relating the incident to Iran, which they by-and-large perceive as a worse threat to America. From Arizona Wednesday, Texas congressman and Republican Party candidate Ron Paul opposed Syria intervention, citing that America could not financially afford to involve itself in this time.

On the topic of Iran, Paul opined, ?If they are so determined to go to war, the only thing I plead with you for, if this is the case, is do it properly. Ask the people and ask the Congress for a declaration of war. This is war and people are going to die. And you have got to get a declaration of war.?

Man United's cash reserves fall

By ROB HARRIS

updated 12:40 p.m. ET Feb. 21, 2012

LONDON - Manchester United's cash reserves fell by 100 million pounds ($158 million) in six months partially to finance an investment in a roster failing to maintain the English champions' dominance.

As a result of spending that also took in stadium improvements and a bond repurchase program, the Old Trafford bank balance dropped from 150.6 million pounds to 50.9 million pounds ($238 million to $80 million) to Dec. 31, the club's quarterly accounts revealed on Tuesday.

Despite net spending of 48 million pounds ($76 million) on new players, including goalkeeper David de Gea, defender Phil Jones and winger Ashley Young, United failed to advance past the first round of the Champions League and has been eliminated from both domestic cups. Meanwhile, neighbor Manchester City holds two-point lead in the Premier League.

United spent 5.3 million pounds ($8.4 million) in the three months ending Dec. 31 buying back bonds that were issued two years ago to raise 504 million pounds (then $762 million) to replace long-term financing and reduce debts to hedge funds.

United has spent 92.8 million pounds ($147 million) repurchasing that debt ? more than the 80 million pounds (then $130 million) received from Real Madrid in 2009 for the sale of Cristiano Ronaldo.

The club's debt, resulting from the 2005 takeover by the American Glazer family, stood at 439 million pounds ($694 million) at the end of 2011 and incurred almost 24.5 million pounds ($39 million) in interest payments in six months.

Although the debt was down from the 508 million pounds at the end of 2010 it rose again in the final three months of 2011 by 6 million pounds ($9.5 million).

However, United's moneymaking abilities appear to be undiminished, with 175 million pounds ($277 million) in revenue in the six months ending Dec. 31 ? up more than 10 percent on the same period a year earlier due largely to a rise in TV income and a new training jersey sponsorship deal with express delivery and freight firm DHL.

"Revenues continue to grow strongly although costs are increasing just as quickly so pretty much negating that growth," the Manchester United Supporters' Trust said in a statement. "However the key figures of interest to supporters show the Glazers have now spent every penny of the money received from the sale of Ronaldo, and more.

"That's now 92.8 million pounds spent on buying back their own bond debt that they loaded onto our club."

MUST said that since Ronaldo's departure, net transfers totaled 90 million pounds ($142 million) while 225 million pounds ($356 million) had been taken out of the club to cover debt payments and interest.

"What could the club have done with that extra 225 million pounds? Cheaper tickets for loyal fans, investing massively in the squad and stadium, developing and retaining the best youth players, competing on an equal basis with the very best teams in Europe," MUST said. "This is the true cost to Manchester United of the Glazers' ownership."

Gases drawn into smog particles stay there, UCI-led study reveals

Tuesday, February 21, 2012

Airborne gases get sucked into stubborn smog particles from which they cannot escape, according to findings by UC Irvine and other researchers published today in the Proceedings of the National Academy of Sciences.

The results could explain a problem identified in recent years: Computer models long used by the U.S. Environmental Protection Agency, California air regulators and others significantly underestimate organic aerosols ? the major component of smog particles. Such pollution blocks views of mountains and has been linked to everything from asthma to heart attacks. It is also the largest unknown in climate change calculations.

"You can't have a lot of confidence in the predicted levels right now," said lead author Veronique Perraud, assistant project scientist to pioneering UCI air chemist Barbara Finlayson-Pitts. "It's extremely important, because if the models do a bad job of predicting particles, we may be underestimating the effects on the public."

An independent expert who reviewed the research for PNAS agreed.

"The conclusions are highly significant," said Purdue University atmospheric chemist Paul Shepson. "This paper should ? and, I expect, will ? have a big impact. We've known for nearly a decade that there's a huge difference between what's in the models and what's actually in the air. Thanks to this paper, we have a much better idea of why."

Scientists at UCI, a U.S. Department of Energy laboratory and Portland State University combined pinene, a common ingredient in household cleaners such as Pine Sol and outdoor emissions, with oxides of nitrogen and ozone to mimic smog buildup.

Models used by regulators for decades have assumed that organic aerosols in such pollution form liquid droplets that quickly dissolve potentially unhealthy gases. But the new work found that once gases are sucked into a particle, they get buried deeper and deeper.

"They check in, and they don't check out. They cannot escape. The material does not readily evaporate and may live longer and grow faster in total mass than previously thought," Finlayson-Pitts said. "This is consistent with related studies showing that smog particles may be an extremely viscous tar."

Perraud noted that broader study needs to be done: "The next logical step is to straighten the models out. We need enough follow-up data to do so."

Sophisticated tools made it easier to pinpoint the exact characteristics of chemical compounds in air. The scientists used a 26-foot-long "aerosol flow tube" at the AirUCI unit and a one-of-a-kind, 900-pound instrument known as SPLAT (a single particle laser ablation time-of-flight mass spectrometer) at the Pacific Northwest National Laboratory.

"Just business" an inescapable reality of racing - Pop Off Valve

Sarah Fisher's IndyCar team scored a dramatic Cinderella victory at Kentucky last season. Now they are on the sidelines without an engine contract. (Photo by Justin Edmonds/Getty Images)

There's a phrase used all the time in racing that people use to explain unpopular decisions. I'm sure you've heard it once or twice.

"It's just business."

Never mind that that phrase is as satisfying as a bout of constipation - it's still the truth. A lot of aggravating, annoying, devastating, and downright stupid stuff can be explained away by the fact that "it's just business."

Because professional auto racing is a business. It may be a way of life for the drivers, it may be a religion for the fans, but it is neither of these in reality. So those times when we rely on paradigms about whether someone "deserves" something or not are often based on a willful misinterpretation of the sport's nature. The only justice that is served is towards the bottom line.

Star-divide

There is a lot of unpleasantness to be had in racing because of that sometimes harsh truth. Lindy Thackston, an absolute gem of a person - telegenic, photogenic, smart, funny, capable - was not hired to return to IndyCar broadcasts this year. Sarah Fisher Hartman Racing went out and signed the hottest rookie driver in American open-wheel racing, got a sponsor for a full season, and was ready to take on the world - except that there is no motor in the team's brand new Dallara DW12, nor is there likely to be until Indianapolis at the earliest. Fan favorite Pippa Mann continues her prodigious and enthusiastic engagement on social media, yet she does not have a ride for 2012. Michael Shank Racing, a team which beat the best in Grand American sports car racing at the Rolex 24 Hours of Daytona, may end up missing the 2012 IndyCar season if they cannot get either the funding, the driver, or the engine package sorted in time.

Why is this? Well, if you want to ignore the maxim introduced at the start of this post, there are a multitude of culprits available to blame. I won't go into them all here, but I will mention that one common mantra that seems to keep surfacing is that INDYCAR hasn't done enough to make these deals happen. Whatever else might be the causative agents for these calamities, it appears to be agreed that the sanction hasn't wielded its financial and political might to "lubricate the hinges," so to speak.

If I'm being honest, that attitude kind of pisses me off.

It's not that I have any particular love or loyalty for INDYCAR. I find the people who work there charming and personable, but I historically haven't let that fact impede me from offering criticisms - always attempting to be objective about it, but oftentimes levying some very harsh assessments of their performance. But in this case, I want to ask the question - exactly how much welfare should INDYCAR be responsible for before things get out of control?

That's right, I said "welfare." As in a subjectively-based system that provides materials, financing, and other assets based on an ephemeral sense of need or an intangible set of advantages which begs the circumvention of the natural course of business.

It's clear that INDYCAR's competitors and fans expect a bit of welfare to be doled out, largely because the precedent was set from the very founding days of the Indy Racing League (remember 25/8?). And once you have established that you are willing to give out something that is normally earned, whether for free or for a deep discount, it is unbelievably hard to wean the recipients off of the dole. People get used to the helping hand and, in fact, end up budgeting it into their decision-making by default after a while.

Take, for example, the recent brouhaha involving the Leader's Circle money. Randy Bernard, INDYCAR CEO, decided to reevaluate what constitutes merit for these Leader's Circle bonuses when Newman-Haas Racing could not answer the bell in 2012. He elected to disburse Newman-Haas' unused Leader's Circle payouts to the teams which offered the most compelling presentation about how they would activate their participation in the sport to bring in new fans, new sponsors, and new interest.

The Oklahoma land rush that followed included small fries like Michael Shank and big fish such as Chip Ganassi. But the two teams who walked away from the meeting were Ed Carpenter Racing and Dragon Racing. Hunh? How could the Indianapolis 500-winning team be left out in the cold? How could a team like Novo Nordisk Chip Ganassi Racing, who provides one of the most compelling storylines in racing with diabetic Charlie Kimball and is a champion at sponsor activation, be passed over?

The answer was actually quite simple - Bernard and company had a set of criteria that they employed to judge the presentations without regard to prestige or entitlement - but by now you know that the simple answer is not the one people like to hear. Bryan Herta in particular was reportedly furious at being denied the Leader's Circle money - not because he needed it to get on track, but because he stated that being part of the Leader's Circle plan meant (to him, at least) that his team was one of the 20 most important teams in INDYCAR.

That sort of subjective thinking gets people into trouble in business, particularly in the racing business. People can kvetch all they want about the hoops that you're required to jump through ("You mean this money is contingent on a glorified PowerPoint presentation???"), but you still have to jump through them to get the carrot.

That's not to say that there shouldn't be sympathy for those affected by business realities. I am as furious as anyone that people I consider to be, if not friends, then people with whom I wish I were friends, are facing struggles on the business side of racing. I will gladly roll out the #THACKONTRACK and #engineforsarah hashtags on Twitter; I will do my best to keep Pippa Mann's name trending with the resources I have; I will cross every finger and toe that I possess in the hopes that Michael Shank answers the bell at St. Petersburg.

But if none of that stuff works out the way I want, I am not going to call it a "travesty" or an "injustice" or a "catastrophe," even if that's how I feel. I have spent nearly two decades on the business side of racing and have learned that feelings are far too easily hurt or trampled, and that sometimes things won't work out practically even if I think it's a slam dunk subjectively.

There was the time that one of my clients was hired by one of the sport's biggest teams on a substitute basis, drove his ass off and made headlines doing it, and in the end was still replaced by a driver whose agent had a friendly (and profitable) relationship with the team owner. Then there was the rising young star whose family mortgaged a significant chunk of their personal money and years' worth of careful planning to send him up the racing ladder. But even though he won a nationally-televised race and seemed destined for a stellar career, his family-owned team was bought out, he was "reluctantly" released, and now he is out of the sport completely.

Those are only two examples from a backlog from which I could write a series of books. And make no mistake, I still feel the outrage and frustration of every single instance. But no amount of slamming my head against a wall will change what happened - or, indeed, what will happen to other people I care about as the racing world grinds inexorably on.

So when I tell people I don't want INDYCAR to make special exceptions for certain people or teams or sponsors or other parties, it's not because I don't care. It's because none of this is about justice or entitlement or fairness or karma.

It's not pleasant. But it's just business.

Gamer or MMAer, UFC Undisputed is Thumbs Up (Video Game ...

UFC Undisputed 3 cover Anderson SilvaI have a PlayStation 3, but I am not a gamer ? well, I do sometimes spend a few hours a month when I can?t sleep on GT5, but in the main, I use Sony?s masterpiece as a media server more than anything else. So when UFC Undisputed 3 arrived through the letterbox, I was curious to see if it could appeal to someone who actually trains and knows how to fight, but not with a joy pad.

First impressions of Undisputed are good ? once you get past the initial slow loading phase of a first install, but after that it is very slick, with strong imagery, UFC branding, and very good character definitions that provide the backbone of your experience.

The ideal way to start your Undisputed experience is by going into the gym and training the basics: drilling takedowns, power strikes, blocks, and movement, as well as working on more complex controls like submissions and escapes. For someone who has a passing interest in the sport, it will provide a useful insight into the actual real work training, but to someone who actively burns their toes on jigsaw mats, there is a welcome familiarity to the way the game is laid out and you can really tell that the research work has been extensive for this release.

Once you have grasped the basic controls you can thrust yourself into the actual challenge of the game ? beating opponents in a career timeline or dropping in and out for matches that really appeal in an arcade or exhibition format against the PS3 itself or a willing second player.

Cajoling the wife into being the second player, we set about battling our way through the ranks of the UFC?s weight divisions, each picking our favorite characters of the current roster, but disappointingly, unable to chose some of our heroes from days gone by (i.e., Randy Couture, Chuck Liddell and so on). Things improved when we switched over to Pride mode and were able to give San Luis Obispo?s finest a whirl in a totally different environment, as well as a long list of other retired heroes such as Gary Goodridge, Don Frye, and the like.

In fact, we found in arcade mode at least, we preferred the Pride environment, as the character choices were better, the addition of Stephen Quadros and Bas Rutten on the commentary, and the referee cam all made the experience more nostalgic and something special ? like re-watching your old Pride DVDs.

Moving back to the UFC career mode side of the game, this is where the real longevity in the product comes to the fore. The basic premise being that you can build and customize your own fighter, compete at various events to build experience and skill, as well as building your ranking in a particular category.

The eventual aim is of course to tackle a champion, be it Georges St-Pierre, Anderson Silva, or another standout at the top of the food chain. To do this you will need a healthy training camp and a comprehensive set of skills. Thankfully, you can develop this by training at various camps around the world and honing particular areas of your fighting style that feel may be lacking.

There are times when the process of getting to grips with the game controls can become exasperating, remembering a predefined set of button controls in order to control your character, but that in turn is a process of discovery and provides its own unique learning curve.

Where you might look at a fight in the flesh or training in the gym and identify immediately what it is you or the fighter you are rooting for would need to do, it?s harder when you feel the buttons aren?t responding to your fingers. The thing is, if your competitive streak kicks in, you aren?t going to want the game to beat you, but you really have to put your ego to the side and focus on learning things in a thorough manner and drilling them to perfection.

Visually, the game is stunning and very fluid in its delivery, from ring entrances to action specific commentary, but I somehow found the renders of fighters in Pride mode to be a better likeness to actual fighters ? check out Vitor Belfort or Dan Henderson to see what I mean.

UFC Undisputed 3 has a strong appeal if you are a hardcore gamer or, like myself, are a connoisseur of the sport, but not a gamer per se. The career mode is the real meat of the product and has more than enough depth to really draw you in and make it a formidable killer of social life, but the exhibition mode is, in my eyes, the real fun part of the game and something that will no doubt find its way into reception rooms in dojos all over the world.

Katy Perry Spotted Shooting New Video On Military Base

'Part of Me' singer was seen wearing army fatigues on set in California.

Katy Perry may be deep in shooting the video for her latest single, "Part of Me." The singer was spotted wearing a military uniform on the set of something this week.

In several photos that made their way online, Perry dons a cropped black wig and fatigues. One shot is of her standing next to male soldiers. Another features her is of her standing in a store. The last photo is of her in a pool with a soldier (still wearing the army garb). According to Perez Hilton, she is shooting the military-themed video at Marine Corps base Camp Pendleton in Oceanside, California.

A rep for the base could not confirm reports that she is shooting there when contacted by MTV News. Meanwhile, her rep had not responded to our request for comment by press time.

Earlier this week, Perry teased that she was looking forward to hitting the set for the "Part of Me" video. "Holy power of the Grammy's, Part Of Me is already top 10 on itunes! U guys are killing it! NICE! Can't wait to shoot this video!" she tweeted on Monday, one day after she debuted the song at the Grammys.

The Teenage Dream: Complete Confection song is a bit darker than most Perry fans might be used to. The song is about the dissolution of a relationship, during which Perry sings scathing lines like "Days like this I want to drive away/ Pack bags and watch your shadow fade/ You chewed me up and spit me out like I was poison in your mouth/ You took my life, you drank me down/ But that was then and this is now."

And in what has been taken as a jab at her former hubby, Russell Brand, she adds, "You can keep the diamond ring/ It don't mean nothing anyway."

What did you think of Katy Perry's Grammys performance? Leave your comment below!

EU court: Web sites need not check for IP breaches (AP)

BRUSSELS ? A European Union court ruled Thursday that social networking sites cannot be compelled to install general filters to prevent the illegal trading of music and other copyrighted material.

The decision is a victory for operators of social networking sites in the EU, but a setback for those who seek to protect copyrighted material from being distributed without payment or permission.

It also comes as protests are growing in Europe against ACTA, the proposed international Anti-Counterfeiting Trade Agreement, which is meant to protect intellectual property rights.

In Thursday's decision, the EU Court of Justice, which is based in Luxembourg, ruled that requiring general filters that would cover all the site's users would not sufficiently protect personal data or the freedom to receive and impart information.

SABAM, a Belgian company that represents authors, composers and music publishers, filed the lawsuit leading to Thursday's ruling. In it, the company objected to the practices of Netlog NV, a social networking site, saying users' profiles allowed protected works to be shared illegally.

Michael Gardner, head of the intellectual property practice at London law firm Wedlake Bell, called the ruling a further blow to copyright owners because it appears to rule out forcing operators of social network sites and Internet service providers ? at their own expense ? to impose blanket monitoring and filtering aimed at stopping infringements.

In November, SABAM lost a separate case in which it sought to require Internet service providers to install filters that would prevent the illegal downloading of files.

Gardner said the ruling would not stop copyright owners from seeking more limited injunctions against social networking sites or Internet service providers, but he said the injunctions would have to be more "proportionate" in scope and effect.

"Under EU law, there has to be a balance between the interests of copyright owners and the rights of privacy and freedom of expression," he said. "So far, the courts seem to have rejected the draconian solutions urged on them by the rights owners."

Mark Owen, head of the intellectual property practice at London law firm Harbottle & Lewis, said the new ruling shows how difficult it can be to protect intellectual property.

"As clouds continue to gather around Anti-Counterfeiting Trade Agreement and other attempts to control online use of copyright works, today's ruling from the European Court provides a useful illustration of the practical challenges enforcement poses," Owen said.

1 in 6 Americans has no health insurance - Handling Hard Times ...

1 in 6 Americans has no health insurance

February 15th, 2012, 1:00 am ? ? posted by Mary Ann Milbourn

Nearly one out of six Americans was uninsured last year as fewer employers provided medical coverage, according to a Gallup-Healthways Well-Being survey.

The survey showed 17% of Americans had no health insurance in 2011, up from 14.8% in 2008 as the recession gathered steam.

Meanwhile, well below half of all Americans ? 44.6% ? got their health insurance through their private or government employer, down from 49.1% in 2008.

Those covered through a government health plan ? Medicare, Medicaid or military/veterans? benefits ? edged up to 25.2% in 2011 from 23.4% four years earlier.

Gallup?s conclusion:

?Increased unemployment is likely a factor in declining levels of employer-based health insurance, but is not the sole cause. It appears that even Americans who are in the workforce ? both full- and part-time employees ? are becoming less likely to get their health insurance from their employer. This could be for one of two reasons, and is likely a combination of both: either some workers can no longer afford the rising cost of the health insurance the employer offers or the employer is simply not offering health insurance any longer. Additionally, the proportion of the U.S. workforce that is composed of part-time workers ? a group less likely to receive employer-based health insurance than full-time workers ? has increased.?

According to a 2011 Kaiser Family Foundation survey, employer-sponsored family health insurance cost $15,073 last year, up 9% from 2010. Of that, workers contributed on average $4,129 to the premium cost while employers paid $10,944.

Republicans take Solyndra message to Obama (AP)

WASHINGTON ? If you want a window into how outside Republican groups are likely to assail President Barack Obama's record this year, look no further than how the GOP is lambasting the administration's handling of solar company Solyndra.

Republicans have used Obama's ties to the bankrupt California manufacturer to argue that he plays the same political games that have consumed Washington for generations ? and has failed to live up to promises to change the nation's capital. It's the message GOP-leaning outside groups are promoting in advertising campaigns in states critical to the Democrat's re-election race.

"Tell President Obama American workers aren't pawns in your political games," says one ad run by Americans for Prosperity, a conservative group linked to billionaire oil industry executives Charles and David Koch.

Such ads were among the warning signs the Obama campaign saw before it decided to encourage its donors to financially support a Democratic-leaning super PAC, Priorities USA. The announcement came as outside groups supporting Republican Mitt Romney heaped criticism on rival Newt Gingrich before the Iowa caucuses and in early primary states, a preview of what could confront Obama once the GOP primaries are settled.

For Republicans hoping to unseat Obama, Solyndra has become a code word for his handling of the economy.

Obama visited the company two years ago, lauding it for "leading the way toward a brighter and more prosperous future." It received more than $500 million in federal loans, becoming the first alternative energy company to receive a loan guarantee under a stimulus-law program the Obama administration highlighted as a way to foster green jobs.

But in September 2011, the company went belly up, resulting in the loss of 1,100 jobs and turning the little-known firm into a campaign catch-phrase for Republicans challenging Obama. Republicans have sought to highlight the connection between Obama fundraisers and the company, arguing that the president used government policies to benefit campaign supporters ? and, thus, was no different than the typical Washington politician he promised not to become.

Steve Spinner, an Energy Department official, has raised at least $500,000 for Obama's campaign while Steve Westly, a venture capitalist who was an unpaid adviser to the Energy Department, has raised between $200,000 and $500,000. Emails released by congressional investigators show Spinner was actively involved in the Solyndra loan, despite pledging to step aside because his wife's law firm represented the company. Westly tried to warn Obama against the May 2010 trip to Solyndra's Fremont, Calif., headquarters but the president made the trip anyway.

One of Solyndra's investors was the foundation of George Kaiser, an Oklahoma billionaire who has supported Obama. Kaiser has said he did not play a role in helping Solyndra receive the loan, but emails show he discussed the solar company with the White House at least once and directed business associates on how to approach the administration to help Solyndra grapple with its financial problems.

Obama and Energy Secretary Steven Chu have said the loan program was intended to spark investment in renewable energy programs that otherwise would not qualify for a private loan. They say officials knew from the start that some investments would fail.

A report released last week by a former Treasury official said the government could lose nearly $3 billion on green energy loans ? far less than the $10 billion Congress set aside for the high-risk program. The White House asked a former official to conduct the review in response to investigations by congressional Republicans into the Solyndra

As the GOP presidential race continues, the Republican message aims squarely at undermining Obama's case on rebuilding the economy as well undercutting his perceived strengths among voters on character issues such as honesty and integrity.

"All of the sudden the companies that end up getting the grants are those who happen to be well politically connected," said Whit Ayres, a Republican pollster, explaining the GOP's Solyndra message.

Celinda Lake, a Democratic pollster, said the Republican spots were going after Obama's integrity but also allowed the re-election campaign to deflect the issue and turn the attention to the oil industry's support for Republicans.

"This is kind of like the art of war," Lake said. "You go for your enemy's strength. But if your enemy is smart, your enemy doesn't let you come into their strength."

The Koch group helped energize the Solyndra message last month when it poured $6 million into a minute-long ad in six states crucial to Obama's re-election map: Iowa, Michigan, North Carolina, Ohio, Virginia and Wisconsin. The ad accused Obama's campaign of raising money from Solyndra investors in exchange for the large federal loan, which couldn't prevent the bankruptcy and job losses.

Obama's campaign responded with its own ad ? the first of his re-election campaign.

It told voters the president was under attack by "secretive oil billionaires" and defended his record on energy. The ad ? at a cost of $2.5 million ? ran in the same six states where Americans for Prosperity aired its ad.

Most notably, Obama's team used the spot to rebut the charges of political machinations, calling the president's record on ethics "unprecedented" and claiming that Obama "kept a campaign promise to toughen ethics rules."

American Crossroads, a super PAC connected to Republican strategist Karl Rove, weighed in recently as well. It paid about $500,000 to air a similar spot that called Solyndra a "big government fiasco." It raised the issue of whether Obama supporters benefited from billions in taxpayer money while laid-off workers were "forgotten ? typical Washington."

The Koch brothers have said they intend to remain active this election cycle.

99% A Separation

All Critics (105) | Top Critics (36) | Fresh (105) | Rotten (1) | DVD (2)

Very few movies capture as convincingly as A Separation does the ways in which seemingly honorable decisions can lead to interpersonal conflict -- even disaster.

To say the piercing Iranian film A Separation is about divorce is a bit like saying The Wizard of Oz is about a pair of slippers.

"A Separation" moves beyond one couple's sundering marriage to reveal growing rifts between generations, ideologies, religious mind-sets, genders and classes in contemporary Iran.

"A Separation" is a great movie, a look inside a world so foreign that it might as well be another planet, yet so universal that its observations are painfully familiar to anyone, anywhere.

Asghar Farhadi's emotionally epic movie is not just a masterpiece dramatically, it is a movie dramatically of its moment.

It's small. It's real. And it's deeply moving.

A Separation shows the human struggle for respect and a better life. It's a struggle rife with human frailty. Asghar Farhadi is a sly writer and director, and leaves us with questions that are provocative and elusive.

Smart, provocative, and brimming with ungovernable human emotions.

A meandering, nerve-wracking, ultimately worthwhile tour of contemporary Iranian urban life.

Above all, Farhadi?s parable teaches that a rush to judgment inevitably turns back on the judge.

It's a portrait of an essential and sympathetic human dilemma, and in that it's both real and timeless in ways that transcend borders, cultures and languages.

Is it possible, the movie asks, that children, with their belief in absolutes, have purer moral compasses than their forced-to-compromise parents?

Partly a courtroom drama, partly a political satire and partly a twisty thriller that gradually draws you in and becomes more engrossing with each new revelation.

Expectedly, the volatility is penetrating, but the feature is methodical, stewing in every last moment of unease and contemplation, stretching to a point where Farhadi is practically lapping himself.

A quietly lacerating portrait of familial discord that morphs into a wider portrait of society and law...While the setting might be foreign, its concerns are universal.

Ambiguous and enigmatic, it revolves around the termination of a marriage in contemporary Tehran.

Farhadi's carefully wrought narrative and the ways it handles the fragile emotions of its characters truly sets it apart, not only from contemporary Iranian cinema but world cinema in general.

What counts is that talented writer/director Asghar Farhadi structures it in a culturally compelling and mysterious way, while balancing all the characters to avoid easily typed "good guys" and "bad guys."

Emotionally resonant beyond the filmmaker's own country and culture, it is a compassionate yet searingly precise film that refuses to name villains, nor to let any of its protagonists off the hook

Sometimes, in an attempt to do the best we can for the people we love, we end up wreaking irreparable damage.

US probes door fires in 2006, 2007 TrailBlazers

DETROIT (AP) ? Federal safety regulators are investigating fires in the driver's side doors of Chevy TrailBlazers, the second such probe in a week.

The latest inquiry involves more than 309,000 TrailBlazer SUVs from the 2006 and 2007 model years. The fires began in the power window switch or related electrical parts, the National Highway Traffic Safety Administration said Monday.

The agency began investigating the TrailBlazer on Thursday, just three days after it opened a probe into similar problems with the 2007 Toyota Camry sedan and RAV4 SUV. None of the vehicles have been recalled.

The vehicles under investigation are popular. The Trailblazer, although phased out in 2009, was among GM's top-sellers. The Camry was the best-selling car in the U.S. last year.

The agency has received 12 complaints of smoke or fires in TrailBlazers. No injuries have been reported, says the SUVs maker, General Motors Co. None of vehicles that caught on fire were destroyed, although some door parts melted and seats were singed, the automaker says.

Several of the TrailBlazer fires happened while the SUVs were moving. Others occurred when the engines were off and the vehicles were unattended.

In one complaint filed with NHTSA, from Oct. 29, 2008, a woman reported that the alarm sounded while her 2006 TrailBlazer was parked in her driveway. When she looked outside, she saw the SUV in flames. Firefighters put out the blaze and told her it started in the driver's door.

"The fire burned the entire driver's side of the vehicle, a portion of the front passenger seat and the roof," she wrote.

GM believes the condition is restricted to the 2006 and 2007 model years. That is because of a parts change made for the 2006 model year that lasted through the end of the 2007 model year, says GM spokesman Alan Adler.

A NHTSA spokeswoman said the agency is in the process of finding out if GM and Toyota Motor Corp. got switches from the same parts maker, and if any other vehicles had them.

Adler says GM does not identify parts supply companies. A message was left for Toyota's safety spokesman in Torrance, Calif.

Three other GM vehicles built on the same undercarriages had the same power window switches, but no fires have been reported in the Buick Ranier, GMC Envoy or Saab 9-7X, Adler said. The other vehicles have different door configurations than the TrailBlazer, he said.

Any TrailBlazer owner who smells burning plastic or whose power windows stop working should contact their dealer, he said.

The TrailBlazer helped to make truck-based SUVs popular in the U.S. during the early 2000s. The SUV was replaced by more the more efficient Chevrolet Traverse, which is built on a car frame. GM sold 309,423 TrailBlazers in 2006 and 2007.

Six Camry and RAV4 fires were reported to NHTSA, but there were no reports of injuries. Most of the fires were minor with damage limited to the doors, but a Camry was destroyed in one case, according to complaints filed with NHTSA.

The Toyota investigation involves more than 830,000 vehicles. The Camry was the top-selling car in the U.S. in 2011.

Both GM and Toyota said they are cooperating with NHTSA in the investigation.
